Fiall in the City of Anaheim on Septanber 15, 1975, at 1:30 p.m„ notice of said
public hearing having been duly giv~n as required by 1aw and in accorc~ance wi.th the
provisions of the Anaheim bhinicipal Ca1e, Chapter 18.03, to hear and consider
evidence for an~ against saicl proposed variance and to investigate and rn~11cP firulings
ancl recam~ulations in connection these~rith; and
Fk~RE'11.5, said G.:;.nission, after due inspection, investi.gation and study mari:,
by itself ancl in its behalf, and zrter due oonsideration of all evidence and r.epores
offerecl at said hearing, does find and determine the following facts:
1. That the petitioner re:~uests the followiriR waivers fran the Anaheim
Mtinicipal Cale, to construct a 304-unit apartment canplex:
(a) SECI'ICmi 18.34. (162.032 - Mirvnnvn floor area. (700 square feet
req'w ;ed 49Ft square feet proposc~cl)
(b} SECPI~3N 18.34.066.030 - R~7uired enclosure of carports.
(open carports ~ir.oposecl)
2. That Waiver 1-a, above~ntionecl, is hereby granted for a minimiun floor
area of 496 square feet, as proposed, on the basis that the Planning Carmission has
previously granted said waiver for efficiency (bachelor) ty~e units, not to exceecl
25~ of. the total niant~s of apartrr~ent units.
3. That Waiver 1-b, above-mentioned, is hereby granted to pernut 304 open
carport spaces to allow for visibility through said caL-ports; and on the basis that
the Planning Cam~i.ssion has previously approved such carports having ~x-+rtia).
enclosures; subject to the condition that the required 100 cubic feet o£ general
storage • area be prwided acljacent t~o each of the respective apartinent units, si.nce
the 304 carport spaces will have on].y partial wa].ls. ~
4. That the petitioner stipulated to provicling supplenental envirormiental
impact inforrtiation pertaining to the existing natural spring on the subject pmperty
ancl the proposed treatsnent for same.
5. That the petitioner ~ ipulateci to fully lar~dscaping the setbaak area
between the proposc~i chai.nlink fence along the north property line and the northerly
approximately one-half of the east property line; and that the P].anning Cafmission
does hereby detesmine that said lanciscaping and fence will serve as an adequate
buffer ancl that a 6-foot high block wa1Z is not neces_sazy alorxJ the north propesty
line hetween the golf course in the City of Yorba Li.nda anci the proposecl multiple--
fami.ly develognent because of the topegraphic differ~nces between the two properties.
6. That there are ex.~epti.onal or extraordinary circiunstances or conditions
aPplicable to the prop~sty involved or to the interxled use of the property that do
~t apply generally to the property or class of use in the s~ne vicinity arxl zone.
7. That the requestad vari.ance is necessary for the preservation and
enjolmient of a substantial pro~xty right possessed by other prope~cty in the same
vicinity anci zune, aixl denied to the property in question.
