Thot the proposed use is properly one Eor which a Conditional Use Pecmit is euthocized by Code Section 18.44.050.070, to permit an automobile service station in the CL (Commercial, Limi:ed) ZONE with waivers of: a. SECTION 18.05.091.020 - Permitted wall siqnincl. (Service station wall signs permitted only o~ building walls that most nearly face the pump islands) b. SECTION 18.87.03~.072 - Landsca in ad'acent to interior bou~dar 1(nes. (2 trees required; none proposed 2. That Waiver 1-a, above-mentioned, is hereby granted on the basis that the pump islands of the proposed service station are not located adjacent to Anaheim Hills R.oad but, rather, are lacated towards th~: interior of the shopping center. 3, That Waiver 1-b, above-mentioned, is hereby gr'anted conditionally, since the petitio~er stipulated that 25 trees would be provided or the service station site but not necessarily on 20-foot centers adjacent to the interior boundary lines as speciFically required by Code. 4. That it is deter~nined that a service statir~n at the proposed location wouid not be unreasonable. 5, ThaY the petitiener stipulated that the monument sign indicated on Exhibit 1 of the submttted plans and located at the southwest corner of the service stat'ion site will not advertise the service station but will ident,ify the shopping cente~r only. 6. That the proposed use, as gran*_ed, wi'll not adversely af!ect the adJoining land uses and the growth and development of the area in which it is propo5ed to be lor,ated. 7. That the size and shape of the site preposed for the use, as granted, is adequate to allow the full development of the proposed use in a manner not detrimental to the, particular area nor to the peace, health, safety, and general welfare of the Citlzens of the City of Anaheim. ' 8, That the Conditional Use Psrmit, as grsnted, and under the conditions imposed will not be detrimental to the peace, health, safety, and generaJ welfare of the Citizens of the City of Anaheim. ' 9, That two (2) persons indicated their presence at said public hearing in opposition, one of whom appeared in opposition; and no correspondence wa5 received in opposition to subject petition. _1_ RESOLUTION N0. PC75-2 ~ ~ ENVIRONMENTAL IMPACT REPORT FiNDING: Since Environmental Impact Report No. 85, was certified by the City C?uncil on January 30, 1973~ and considered in connection with a gradtng pian for the shopptng center•which included a service st~tion, the Planning Commission believes ihat said draft EIR No. 35 is still in conformance with the City and State Guidelines and the State of California Environmental Quality Act and, based upon such information does hereby recommend to the City Council that they reaffirm their original certification that said EIR No. 85 is in compliance with said Environmental Quality Act, NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commiss?on does her~by grant in part subject Petition for Conditional Use Permit, upon the follow'ng conditions •-~hich are hereby found te be a necessary prerequfsite to the Froposed use of the subject prooerty in order to preserve the safety and general welfare of the Cit~tens of the City of Anaheim: 1. That trash storage areas shall be provided in accordance with approve~ plans on file with the office of the Director of Public Works. 2. That subject property shall be developed substantially in accordance with p~ans and specifications on file with.the City of Anaheim marked Exhibit Nos, 1, 2, 3 ana 4; provided, however, that 25 Yrees shall be provided on the service station site, as stipulated to by the petitioner, said Y~ees to be located subject to approval by the Developme.nt Services Department; and the mo~ument sign indicated on Exhibit No. 7 at the southwest corner of tfie service statian site shall not advertise the service si~tion but shall i~er.tify the shopping center only. 3, That Condition Nos. 1 and 2, above-mentioned, shail be complied with prior to finai building and zoning inspe..tions.
