P~75-20 A RESOLU1lON OF THE rITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2663 BE DENIED WHEREAS, the City Planning Commission of the City of Maheim did receive a verified Petition for Variance from MAR I ON CARTER, 337 Calle Felicidad, San Clemente, California 92672 (Owner); AL WIENER, 866 South Harbor Boulevard, Anaheim, California 92805 (Agent) of certain real property situated in the City of Anaheim, County of Orange, State of California, described as Lot No. 36 of Tract No. 1392 as per map recorded in the office ~f the County Recorder of said County; and WI-IEREAS, the City Planning Commission did hold a public hearing at thc City Hall in the City of Anaheim on J anua ry 20 , 1975 , at 1: 30o'clock p.m., notice of said public hearing having been duly ~iven as rcquired by law and in acwrdance with the provisions of the Maheim Municipal Code, Chapter 18.03,to hear and consider evidence for and against said p~oposed variance and to investigate and make findings and recommendations i~i cannecti~n therewith; and WHEREAS, said Commission, after due inspection, investigation, and study madc by itself and in its behalf, and after due consideration of all evidencc and reports offercd at said hearing, does find and detcrmine the Collowing facts: ]. Thatthepetitionerrequests the fol lowing variances from the Anaheim Municipal Code, to establish a modeling agency in the CO (Commercial, Office and Professionol) Zone: a. SECTION 18.05.09Z - Permitted si nin .(Free-standing signs not permitted in the CO Zone b. SECTION 18.41.020 - Permitted uses. (Modeling agency not permitted in t.he CO - Zone) 2. That the above-menlioned waivers are hereby denied on the basis that the petitioner ir,dicated the existing use was for a modeling agency and studio, and said use is not permitted in the CO Zone. 3, That there are no exceptional or extraordinary c.i~cumstances or conditions appli- cable to the property involved or to the intended use of the property that d~ not apply generally to the property or class of use in the same vicinity and zone, 4. That the requested variancc is not necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question. 5, That the requested variance will be materially detrimental to the public welfare or injur'sous to the property or improvements in such vicinity and zone in which the property is lucated. 6. That no one indicated their presence at said public hearing in opposition, and no correspondence was received in o¢position to subject petition. ENVIRONMrNTAL IMP~,CT REPORT FINDING: That th~ Director of Development Services has determined that the proposed activity falls within the dpfinition of Section 3.01, Class 1 of the City of Anaheim Guidelines to the Requirements for an Environmental Impact Report and'is, therefore, categorically exempt from the requirement to file an EIR.
