PC75-Z~ A RESOLUTION OF ~iHE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION F'OR VARIANCE NO. : b66 BE GRANTED WHEREAS, the City Pl~nning Commission of the City of Anaheim did receive a verified petitian for Vedenca from TH011AS b HERMINDA R. CASTRO, 1202 Devonshire Itoad, Anaheim, Galifornia 92801 (Owners) of certain real prcperty situated in the City of An~aheim, County of Orange, State of California, described as Lot 1, Tract i795, as shown on a map thereof recorded in book 58, pages 3 and 4, Miscellaneous Maps, records of said Orange County ; and WHEREAS, the City Planning Commission did hold a public heering et the City Hall in the City of Anaheim on ~anuary 20, 1975, ef. l; 30 o'clock P.M., notice of said public hearinp, having been duly given as requlred by lew and ln accordance with !he provisions of the Maheim Municipal Code, Chepter 18,03, to hear and consider evi- dence for and against seid proposed verience and to investigote end make (indings and recummendations in connection therewith; end WHEREAS, said Commission, eEter due inspection, investigation, and stndy made by itself nnd in its behelf, and ettec due rnnsideration of oll evidence and report; otEered at said hesring, daes find nnd deteemine the tollowing facts: 1. Thatthepetitionerrequests the following variance from the Anaheim Municipal Code, to permit an exi,ting fence: SECTION 18.04.043.101 - Maximum fence heiqht, ( 1 feet permitted; 5 feet existing) 2. That the above-mentioned waiver is hereby granted on the basis Cfiat the property owners immediately adjacent to the subject property endorsed the subject petition in favor. 3. ENVIRGNMENTAL IMPACT REPORT FINDING: That the Director of Development Services has determined that the proposed activity falls within the definition of Section 3.01, Class 3 of the City of Anaheim GuiGelines to the Requirements for an Environmental Impact Report and is, therefore. ca:egorically exempt from the requirement to file an EIR. .1~ DEV-66~C RESOLUTION N0. PC75-21 .. • - ~ ~ NOW, THEREFORC, BE IT RESOLVED that the Aneheim City Planning Commission docs hereby grant subject Petition for Varience, upon the following conditions which are hereby found to be a necessary prerequzsite to the pro- posed use of the subject property :~ ordee to preserve the safety and generel welfare of the Citizans of the City of Anaheim: 1, That subject property shall be developed substantially in accoo'riance with plans and specifications on file with the City of Anaheim Rarked Exhibit Nos. l, 2 and 3, 2.
