PC 75-24„ ~ ~ RESOLUTION N0. PC75-24 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSIOP! DENYING REQUEST TO DELEI'E CUNDITION OF APPROVAL 0~ CONDITIONAL USE PERMIT N0. 1130, . WITHOUT PREJUDICE • WFIEi<EAS, on August 11, 1969, the Anaheim City Planning Commission granted Conditional Use Permit No. 1130 in Resolution No. PC69-173 to expand an existing medical and hospital center with waiver of mar.imum building he~oximatelr~835tfeet consisting of approximately 10 acres, having a frontage of app Y on the south side of Romneya Drive, having a rnaximum depth of approximate?y 427 feet, being located approximate~y 820 feet west of the centerline of Euclid Street, and further described as 1825 West Romneya Ds•ive; and , WHEREAS, in granting said f.onditional Use Permit, the Planning Commissio~ imposed several conditions, including Condition No. 6"That a parkway maintenance assessment district to provide for perpetual maintenance of the median planter proposed in Romneya Orive shall be established in accordance v+ith Council Policy No. 532"; and WHER'EAS, the petitioner submitted a written request dated December 31, 1974 for rehearing of said Conditional Use Permit to consider deletion of Londiti~n ~f Approval No. 6; and 6tHE'REAS, the Anaheim City Planning Lunmission did hold a p~m~~~notacenofasaide City Hall in the City of Anaheim on FeL:~~ary 3~ 1975, at 1:30 p. public hearing having been duly given as required by law and in accordance ~aith the provisions of the Anaheim Municipal Code, to hear and consider ev9dence for and against said proposal and to i~vestigate and make findings and recomntindations in connection therewifi~c; and • ' WHEREAS, said Commission, after due inspection, investigation and study mad~ by itself anQ in its behalf, and after due consideration ef,all evidence and re~orts offered at sa1d hearing, DOES HEREBY F~ND: 1. That the portion of Romneya Drive in question dous not presently extend past t1~e subject property to the west and, therefore, the subject property owners are deriving the majority of the benefit of said street. p, That a proposal for development of the property to the west of subject property (Anaheim Shores) was apprcved subject to a similar condition of approval requiring a parkway maintenance assessment districL for per- petual maintenance of a median planter•in Romneya Drive and, therefore, granting the subject request fr~r deletion,of subject condition would escablish an undesirabl~e precedEnt since a similar request might be sub- m'i'tted for the property tb the west. 3, That at such time as Romneya Drive is improved tllrough the subject property art~d through the adjacent property to the west, and following acceptance • af s.aid street impr~ovemec~ts by the Lity, upon request by the petitioner the Pla~nning Commission may revi,;:v tf~e matter of deletion of the referenced c~ndition again at public hea.ring. 4~ That the Director of Development Services has determined that the proposed activity falls within the definition of Secticn 3•01, Class.i of the City of Anaheim Guidelines to the .Requirements for an Environmental Impact ~ Report and is, therefore,, categorically exempt from the requirement to fiie an EIR. • NOW, THEFEFORE, BE IT RESOLVED that the Anaheim City Planning Commission does heret~y deny request to delete ~Corndition of.Approval No. G of Conditional Use F'ertnit No. 'l130, without prejudice, on the basis of the foregoing findings.
