PC 75-264_ " • ~ ~ RESOLUTiON N0. PC?5°264 RESOLUTION OF TNE CITY PLAPlNING COMMISSION OF THE CITY OF AtlAHEIM THAT PETITION FOR VARIANCE N0. 2748 BE GRANTED. WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance from WILLIAM L. DAVIES, 401 N. Chantilly, Anaheim, CA 92806 (Owner) of certain real property ~ituated in the City of Anaheim, County of Orange, State of California, described as: Lot 5Z of Tract No. 3390, in the City or Anaheim, County of Orange, State of California, as per map recorded in bro~~ 144, pages 3 to 6 inclustve of Miscellaneous Maps, in the Office of the County Recorder of said County. WHEREAS, the City Planning Commission did hold a public hearing at the City hall in the City of Anaheim on November 10, 1975, at 1:30 p.m., notice of said public hearing having been duly given as required by law and ir, accordance with the provisions of the A~aheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed Varidnce and to investigate and make findings and recortmendations in connection therewith; said pubtic hearing having been con- tinued to the Planning Commission meeti~g of December 22, 1975: and WHEREAS, said Commission, after due inspectlon, investigation and study made by itseif and in its behalf, and after due constderation of all evidence and reports offered at said hearing, does find and determine the following facts: l. That the above-mentioned waiver is hereby granted on the basis that the subject.garage conversion was existing at the time the petitioner pur~hased the property and the petitioner was unaware that said conversion ~as constructed illegally and without the appropriate building permits; that, in addition to the one-car garage remaining on the property, the petitioner is able to provide two additional on- site parking spaces in the 20-foot deep driveway and two on-street parking spaces since the property is lOG feet wide along the street frontage; and, fiurthermore, the petitioner demonstrated tha~ a hardship would be created if said waiver were not granted. 3. That there are exceptional or extraord~nary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 4. That the requested variance is necessary for the preservation and en~oy- ment of a sabstantia'I property right possessed by other property in the same vicinity and zone, arid denied to the property in question. 5. 7hat the requested variance will not be materially detrimen~al to the public welfare or in~urious to the property or improvements in such vicinity and zone in which the property is located. 6. ENVIRONMENTAL IIdPACT REPORT FINDING: That the flirector of the Planning degartme~t ha~ determined that the pro- posed activity falls within the definition of Section 3.~'~. Class 1, of the i.~~Y of Anaheim Guidelines to the Requfrements for an Environmental Impact Report and is, therefore. categorically exempt from the ~equirenent to file ~n EIR. P~OW, 'iHEREFOkE, DE IT RESOLVED that the Anaheim City Planning Corrmission cloes hereby grant sut~~8ct Petition for Variarice, upon the followin4 condition which is hereby found to be a necessary prerequlsite to the proposed use ~~f the_sub~ect property in order 'to preserve the safety and general we1fare of the Citizens nf the City of Anaheim: 1.
