WHEREAS, the City Planninq Commission did hold a public hearing at ttie City Hall in the City of Anaheim on December 22, 1975, at 1:3~ P~m., notice of said public hearing having been duly given as required by law and in accordance a~ith the provisions of the Anaheim Municipal Lode, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use and to investiqate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due cansidera[ion of all evidence and reports offered at said hearinq, does find and determine the following facts: 1. That the proposed use is properly one for which a conditlonal use permit is authorized by Code Section 18.61.05~.390, to wit:. permit on-sale beer and wine at a private tennis facility. That the petitioner stipulated thai on-sale beer and wine would be available .only during the reyular hours of operation of the private tennis facility, from 7:00 a.m. to 11:00 p.m. daily. 3. That the petitioner stipulated that the on-sale beer and wine will be in conjunction with the serving of ineals only and to patrons of the tennis facility. 4. That the petitioner stipulated to removing any existing billboards which may be located on the subiect property, said removal ta be compteted within 30 days of the date of this resolution. 5, That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to he located. 6. That the size and shape of the site proposed for the use is adequat~ to allow the `ull development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the City of Anahefm. 7. 'fhat the granting of the Conditional Use Permit under the conditions imposed, if any, will not be detrimentat to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. S. That no one indicated their presence at said public hearing in opposition; and no correspondence was received in opposition~ to subject petitton. ENVIRONMENTAL IMPACT REPORT FINDItIG: That the Director of the Planning 6epartmF:nt has determined that the pro- posed ectivity fa11s within the definition of Sect:on 3.01, Class 1, of the City of Anahe?m Guidelines to the Requirements for an Environmental Impact iteport and is, therefore, categorically exempt from the requirements to file an EIR. NOW, TIiEREFORE, DE IT RE50LVED that the Anaheim City Planning Comn9ssion does hereby grant subject Petition for Conditional Use Permit, upon the fullowing ofntheisubjectcpropertyrinyorderdto~preservectheasafetyrandigeneral welfarePofethese Citizens of the City of Anaheim: (1) That subject property shiall be developed subsz:;~rtially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 and 2; provided, however, that any billboards v~hich may exist on the sub3ect property shall be removed within thirty (30) days of the date of this resolution. (2) 7hat on-sale beer and wine shall be available only during the regular ho~rs of operation of the private tennis facility. from 7:00 a.m. to 11:00 o.m., as stipulated to by the petitioner.
