WHEREAS, the City Plann(nq Commission did hold a public hearing at the City Hall in the City of Anaheim on December 22, 1975~ at 1:30 P•m•, notice of said public hearing having been duly givan.as required by law and in accordance with the provisions of Che Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use and to investigate and make findings and recommendattons in connection therewith; and WHEREAS, said Commission, after due inspettion, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1, 7hat the proposed use is properly one for which a conditionel use permit is authorized by Code Section 18.61.050.070, to r~it: permit an automotive service facility in the ML (INDUSTRIAL, LI(~IITED) ZOtJE. 2. That the proposed 12-bay automotive service building a~ill be used in conjunction with an existing automot•ive agency located to the south of and ad;jacent to the subject property. 3. 7hat the petitioner indicated that adequate parking areas were available on the ad~oining property to the south for the proposed use. 4. That the petitioner indicated the construction c~f the Froposed service building will necessitate minor alterations to the pitch and putt portion of the golf facility, but will not result in the removal Qf any holes, as shown on an exhibit submitted by the petitioner to illustrate the required changes. RESOLUTIOtJ N0. PC75-270 ~ ~ 5. That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 6. That the size and shape of the site proposed for the use is adequate to allow the full development of tlie proposed use in a manner not detr?mer.tal to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 7. That the granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, safety, and general i•~elfar~~ of the Citizens of the City of Analieim. 3. Th~t no one indicated their presence at said public hearin9 in opposition; and no correspundence was received in opposition to subject p2tition. EI~VIROPIt1ENTAL IMPACT REPORT FIWDIidG: That the Anaheim City Planning Cortenission does hereby recommend to tne City Council of the City of Anaheim that the subject pro3ect be exempt from the requirement to prepare an environmental impact report, pursuant to the provisions of the California Environmental Quality Act. NOW, THEREFORE, f3E IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Corditional Use Permit, upon the following conditions which are hereby found ~ro be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: (1) That trash stora9e areas shall be orovided in accordance with aoproved plans on file with the office of the Director of PUbtic lJorks. (2) 7hat fire iiya~~ants shall be installed and charged as required and determined to be necessary by tlie Chief of the Fire Department prior to commencement of structural framing. (3) That subject property sl~all be served by underground utilities. (4) That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. (5) In the event that subject propert,y is to be divided for the purpose of sale, lease or financing, a parcel map to record the approved division of subject property shall be submitted to and approved by the City of Anaheim and then be re- corded in the office of the Orange County Recorder. (6) That approoriate water assessment fees as determined by the Director of Public Utilities shall be paid to the ~ity of Anaheim prior to the issuance of a building permit. (7) That subject property shall be developed substaRtially in accordance with plans and snecifications on file ~~~ith the City of Anaheim marked Exhibit IJos. 1, 2, and 3. (a) That Condition Nos. 1, 3, h, and 7, above-mentioned, shall be complied with prior to final building anJ zonin9 inspections.
