WHEREAS, the City Planning Commissiun dtd hold a public hearing at the City
Hall in the City of Anaheim on December 22, 1975~ at 1:30 P.M.~ notice of sald
public hearing s~a.uing been duly 91ven as required by law and fn accordance with the
provl•sions of tM~ Xnahefm Municipal.Code, Chapter 18.03~ to hear and consider evidence
for and against sald proposed conditional use and to lnvestigate and make ftndings
and ~er.ommerdation!t in connectton therewith; and
NHEREAS. said Commission, after due inspection. investigation and study made
by itself and in its 5eh.;olf, and after due considerat(on of all evidence and reports
offered at Said hearing, does find and deternine the following facts:

1. That the proposed use is properly one for which a conditi~nal use permit •
is authorized by Code Section 18.61.050.070, to wit: permit an automcbile repair shop
in the ML (Industrial, Lim9ted) Zone.
2. That the proposed use is iiere~.y denied on the basis that the sub'ect building is
is inappropriate for the use since said buiiding was not properly xonstructe~ for an
automobile repair shop; that the proposed use is determined to be incompatible w~th
existing uses in the sub~ect builaing; and that approval would set a precedent for
future similar requests in tF~e ML Zone.
3. That the proposed use will adversely affect the ad~oining 1and uses and
the growth and development of the area in which it is proposed to be located.
4. That the size and shape of the site oroposed for th~ use is not.adequate
to a11ow the full development of the proposed use in a manner not detrimental to the
particular area no~• to the pear,e, health, safeLy, and gsneral welfare of the Citizens
of the City of Anaheim.
5. That th° grantinc~ of the Conditional !Jse Permit will be detrim~ntal to the
peace~ health, safety, and general welfare uf the ~itizens nf the City or Anaheim.
6. That no one indicated their nresence at said public hearing in opposition;
and no correspondence was received in opposition ta sub~ect petition,
ENVIRONMENTAL IMPACT REPORT FINDING:
7hat the Director ~f the Planning OEpartment has determined that the proposed
activity falls within the definition of Section 3.01, Class 1. of the City of Anaheim
Guidelines to the Requirements for an Environmental Impact Report and is, therefere,
categorically exempt fram the requirement to file an EIR.
f~OW, TIiEREFORE. 8E IT RESOLVED that the Anaheim City Planning Commission
does hereby deny sub~ect Petition for Conditional Use Permit on the basis of the
aforementionei findings.
TNE FOREGOING RESOLUTION is signed and approved by me this 22nd day of
December, 1975.
