WHEREAS, the Ci:';~ P'ianning Commission did hold a pubiic hearing at the City Hall in the City of Anaheim on December 22, 1975, at 1:30 p.m., notice of said public hearin9 having been duly given as required by taw and in accordance with t~ie provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and cansider evidence for and against said proposed conditional use and to investigate and mak~ findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation a~d study made by itself and in its behalf, and after due consideration of all evide~ce and reports offered'at said hearing, does find and deter•mine the following facts: l. That thF Qroposed use is properly one for which a conditional use permit is authorized by Code Section 18.87.Q23, to wit: permit truck ard trailer rentals in conjunction with a service ~tation. 2. That the petiti~ner stipulated that the trucks to be stored on the subje~t property will not exceed 24 feet in length. 3. That the petitioner stipulated that no more than five (5) rental trucks will be stored on the•subject property at any one time~ and that the storage area of said trucks and the rental trailers; as a permitted accessory use of a service station~ ~~~ill not occupy more than 10~ of the total site. 4. That the proposed use will not adversely affect the adjoining land uses and the growth and developme:it of the area in which it is pro~osed to be located. 5. That the size and shape of the site proposed for the use is adequate to allow the full develnpment of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the City of AnahPim. ~ 6. That the granting of the Conditional Use Permit under the conditions imposed, wil7 not be detrimental to the peace, health, safety, and general w~lfare of the Citizens of the City of Anaheim. 7. 7hat no one indicated their presence at said public hearir.g in opposition; and no correspondence was received in opposition Lo sub~ect petition. ENVIRONI~1ENTllI IMPACT REPORT FII~DIP~G: ?hai: the Director of the Plann~n~ Oepartment has determined that the proposed a~tivity falls within the definition of Sec~ion 3.01. Class 1, of the City of Anaheim Guidelines to the Requirements for an Environmental Impact Report and is, therefore, categorically exempt from the reguirement to file an EIk. NOW, THEREFORE, BE IT RESOLVED that the Anahelm City Planning Commission does hereby grant subject Petition for Conditional Use Permi~, upon the following c~nditions which are hereby found to be a necessary prere~uisite tA the proposed use of the sub~ect property in ~rder to preserve tn~ safety and general we?fare of the Citiz~ns of the City of Anaheim: . RESOLU~ION N0. PC75-272 (1) 7hat the owner(s) of subject property shall pay to the City of Anaheim the sum of ~7_.00 per front fout a~ong Lincoln Avenue and Ftagnolia Avenue for street lighting purposes. (2) That the owner(s) of subject ~roperty sha11 pay to the City of Anaheim the sum of 60¢ per front foot along Lincoln Avenue and Magnolia Avenue for tree planting purposes. (3) That subject property shall be developed substantially in accordance with plans an~ specificacions on file with the City of Anaheim marked Exhibit Plo. 1. (4) That Condition ~Vos. 1 and 2, above-mentioned, shall be complied ~aith prior L•o the commencement of the activity authorized under this resolution, or prior to the time that the building permit is issued, or within a period of one year from date hereof, whichever occurs first, or such further time as the Planning Commission and/or City Council may grant. (5) That the rental trucks to be stored on the sunject property shall not exceed 24 feet in length, as s*ipulated to by the petitioner. (6) That no more than five (5) rental trucks shall be stored on the subject pruperty at any one time, and said rental trucks and the rental trailers, as a aer- mitted accessory use at a service station, shall not occupy more than i0% of the total site, as stipulated to by the petitioner.
