PC75-Z~ A RESOLUTION ~F THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEItv1 THAT; FTITION FOR VARIANCE N0. 2668 BE DENIED : WHEREAS, the City Planning Commission of the City of Malieim did receive a venfied Petition for Variance from THE QUALITY INN HOTEL AND GREENHORNS MEAT MARKET, 616 Convention Way, Anaheim, California 92802 (Owner); TERRY L. GEER, 616 Convention Way, Nnaheim, California 928Q2 (Agent) of certain real property situated in the City of Anaheim, County of Orange, State of California, as described in Exhibit "A" attached hereto and referred to herein as though set forth in full; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on Feb rua ry 3, 1975 , at 1:30 o'clock p.m., notice of said public hearing liaving been duly ~iven as required by law and in accordance with the provisions of the Maheim Municipal Code, Chapter 18.03, to hear and consider evidence for ar.d against said proposed variance and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, aftcr due inspection, investigation, and study made by itseif and in its behalf, and after duc consideration of all evidence and reports offered at said hearing, does find and determinc the following facts: 1. Thatthepetitionerrcqucsts the fol lowing waivers from the Anaheim Municipal Code, to allow the use of a restored Cadillac automobile for signing purposes: a. SECTION 18,05.093.021 - Maximum number of signs. (1 p~rmitted; ~ proposed) b. SECTION 18.05.oy3.0211 - Minimum distance between siqns. ( 00 feet required; 36 feet and 116 feet proposed) 2. That the above-mentioned waivers are hereby denied on the basis that an in- operative automobile used for signing purposes is not in keeping with the Sign Ordinance and would set an undesirable precedent, particularly fcr the Commercial Recreation area. 3, That there are no exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone, 4. That the requested variance is not necessary for the preservation and enjoyment of a substantial property right possessed by other properCy in the same vicinity and zone, and denied to the property in question. 5, That the requested variance will be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 6. That no one indicated their presence at said public hearing in opposition and no correspondence was received in opposition to subject petition. ENVIRONMENTAL IMPACT REPGRT FINDING: That the Director of Development 5ervices has determined that the proposed activity falls within t~ie definition of Section 3.Olp.Class 3 of the City of Anaheim Guidelines to the Requirements for an Environmental Impact Report and is, therefore, categorically exempt from the requirement to file an EIR. .
