P~75-38__ ~ A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CiTY OF ANAHEIM THAT FETITION FOR CONDITIONAI USE PERMIT N0. ~.~~ BE GRANTED 1'JHEREAS, the City Planning Commission of the City uPAnaheim did reccivc a verified Petition for Conditional Usc Pennit from WILLIAM REMLAND, 636 East Chapman, Orange, California 92667 ;Owner); MICNAEL AVIRAM, 54'L South Beach Boulevard, Anaheim, California 92804 (Agent) of certain real property situated in the City of Anaheim, County of Orange, State of California, described as 'The West 33d feet of the South 396 feet of the Southwest quarter of the Southwest quarter of.the Northwest quarter of Section 13, in Township 4 South, Range I1 West, in the Rancho Los Coyotes, as per map thereof recorded in book 5~, Page ll, Miscellaneous Maps, records of sa~ic' Orange County. EXCEPTING THEREFROM the Southerly 17S feet of the West 227 feet thereof. ALSO EXCEPTING THEREFROM tha West 92 feet thereof ;nnd 1YHEREAS, the City Planning Commiss(on did hold a public hearing in Lhe City Hall in the City of Anaheim on Feb rua ry 19, 1975 , at 1: 30 0 ~lock p.m., nottce of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipa] Code, Chapter 18.03 ,~o hear and consider evidence for and against said proposed conditiona] use and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission; after due inspeciion, investigation, and study made by itseif and in its behalf, and after duc consideration of all evidence and reports offered at said hearing, does' find and determine the following facts: 1. That the proposed use is properly one for which a Conditional Use Pe*mit is authorized by Code Section 18.44.050.010, to wit: to permit on-sale beer and wine in conjunction with an existing restaurant. 2. That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. 17tat the size and shapc of the site prop~:'d for the use is adequate to allow the full development oC the proposed usc in a manner not detrimenta] to the particular area nor ~o the peace, health, safety, and general welfare of the Citizens of tlie City of Anaheim. 4. That the grantingof the Conditional Use Permit under lhe conditions imposed, if any, will not be detrimental to the peace, health, safety, and generai welfare of tlie Citizens of the City bf Anaheim. 5. That no one indicated their presence at said public hearing in opposition, and no correspondence was received in opposition to subject petition. ENVIRONMENTAL IMPACT REPURT FINDING: That the Director of Development Servlces has determined that the proposed activity falls within the definition of Section 3.~1, Class 1 of the City of Anaheim GuSdelines to the kequirements for an Environmental Impact Report and is, therefore, categorically exempt from the requirement to file an EIR, •1- . PC75-38 ' , NOW, THEREFORE, BE I1~ESOLVED thet the Aneheim City Plennin~Commission does hereby grent subject Petition for Conditional Use Permit, upon the following conditions which ere hereby found to be a necessary prerequisite to the proposed use oE the subject property in order to preserve the sefety end generel welfare of the Citizens ofthe City of Anaheim: l. That subject property shall be devcloped substantially in accordance with plans spe~6fications on file with the City of Anaheim marked Exhibit Nos..l, 2 and 3.
