WHEREAS, the City Planning Commissien did hold a public hearing at the City
Hall of Anaheim on March 3~ 1975, at 1:30 ~,.m., notice of said public hearing having
been dvly y-iven as required by law and iit accordance with the provisions of the
Anai~c'sm Municipal Code, Chapter 18.03, to'r;ear and consider evidence for and against
said proposed reclassification and to investigate a~d i~ake findings and recommendations
in connection therewith; and

WHEREAS, said Comm~ion, after due inspection, inv~igation, and sCudy made
by itself and in its behalf, an~ after due consideration of all evidence and reports
offered at said hearirg, does find and determine the following facts:
l. That the petitioner proposes reclassification of the aoove-described
property from the RS-A-43,000 (RESIDENTIAL/AGRICULTURAL) ZONE to [he RS-HS-22,000
(RESIDENTIAL, SINGLE-FAMILY HILLSIDE) ZONE. ,
2. That the Aneheim General Plan designates subject property for low-density
residential uses~
3• That the proposed reclassification of subject property is necessary and/or
desirable for the orderly and proper development of the community.
4. That the proposed reclassification of subject property does properly relate
to the zones and their permitted uses locally established in close proximity to
subject property and to the zones and their permitted uses generally established
throughout the community.
5. Tnat the proposed reclassification of ~~~ject property requires the dedica-
tion and improvement of abutting streets in accordance with the Circulation Element
of the Anaheim General Plan, due to the anticipated increase in traffic which will
be generated by the intensification of land use.
6. That no one indicated their presence at said public hearin9 in o~position,
ard i~o correspondence was received in opposition to subject petition.
ENVIRONMENTAL IMPACT REPORT FINDING:
That Environmental Impact Repart No. 145, having been considered this date by
the City Planning Commission and evidence, both written and oral, presented to
supplement said draft of EIR No. 145, the City Planning Lommission believes that
said araft of EIR No. 145 does conform to the City and State Guidelines and the
State of California Environmental Quality Act and, based upon such information,
does hereby recommend to the City Council that they certify said EIR is in compliance
with said Environmental Quality Act.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning C~mmission does
hereby recommend to the City Council of the City of Anaheim that subject Petition
for Reclassification be approved and, by so doing; that Title 18-2oning of the
Anaheim Municipal Code be amended to exclude the above-described property from the
RS-A-43,000 (RESIDENTIAL/AGRICULTURAL) ZONE and ta incorporate said descrlbed prop-
erCy into the RS-HS-22,000 (RESIDENTIAL, SINGLE-FAMILY HILLSIDe) ZONE upon the
follow'ing conditions which are hereby found to be a necessary prerequisite to the
proposed use of subject property in order to preserve the safety and general welfare
of the Citizens of the City of Anaheim:
l. That subject property shall be served by underground utilities.
2. That a final tract map of subject property shall be submitted to and
approved by the City Council and then be recorded in the Office of the Orange County
Recorder.
3. That drainage of said property shall be disposed ~if in a manner satisfactory
to the City Engineer. If, in the preparation of the site sufficient grading is
required to necessitate a grading permit, no work on grading will be permitted between
October 15th and April 15th unless all required off-site drainage facilities have
been installed and are operative. Positive assurance shall be provided the City that
such drainage facilities ~aill be completed prior to October 15th. Necessary right-
of-way for off-site drainage facilities shall be dedicated to the City, or the City
Council shall have initiated condemnation proceedings therefor (the costs of which
shall be borne by the developer) prior to the commencement of grading operations.
The required drainage facilities shall be of a size and type sufficiene to carr•y
runoff waters ~riyinatin9 from higher properties through said property to ultimate
disposal as approved by the City Engineer. Said drainage facilities shall be the
first item of construction and shall be completed and be functional throughout the
tract and from the downstreani boundary of the property to the ultimate point uf
disposal prior to the issuance of any final building inspections or occupancy permits.
Orainage district reimbursement agreements may be made available to the developers of
said property upon tneir request.
4. That grading, excavation and all other construction activities shall be
conducted in such a manner so as eo minimize the possibility of any silt originating
from this project being carried into the Santa Ana River by storm water originating
from or flo~ing through this project.
