PC 75-50, ... RESOLUTION N0. PC75-50 A RESOLUTION OF THE CITY PLANNING COMMISSfON OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT N0. 1520 BE GRANTED IN PART. W'HEREAS, the City Planning Commiss~on of the City of Anaheim did receive a verified Petition for Conditional Use Permit from STATE INDUSTRIES, Attn: Arthur E. Haskell, 3383 ~ast Gaee Avenue, Huntington Park, California 90255 (Owner) of certain real property situated in the Lity of Anaheim, County of Orange, State of California, described as: Lot Nos. 4, 5 and 6 of Parcel Map No. 386 as per map recorded in book 59 Pa9` 27 of Parcel Maps, in the office of.the county recorder of said county; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on March 3, 1975, at 1:30 p.m., notice of said public hearing havina been duly gie•en as required by law and in accordance with the pro- visions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said propesed conditional use and to investigate and make findings and recommendations in cennectio~ therewith; and WHEREAS, said Commission, after due inspection, investigation, and study made by itself and in its behalf, and after due consideration of all svidence and reports offered at said hearing, does find and determinE the following facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Code Section 18.61.050.360, to wit: permit a private tennis facility in the NL (INDUSTRIAL, LIGHT) ZONE, with waivers of the following: a. SECTION 18.61.063.012 - Minimum front setback.~ (2 feet rec,uired; 0 feet proposed) b, SECTION 18,61.063.012 - Minimum landsca ed setback. (10 feet required; 0 fe~.~ proposed c, SEC'fION 18.61.064.020 - Maximum fence heictht. (30 inches permitted; 12 feet proposed) 2, That Waivers 1-a, 1-b and 1-c, above-mentioned, are hereby denied on the basis that the petitioner did not demonstrate that a hardship wouid be created if said waivers were not granted. 3, 7hat it was determined that the petitioner should submit the proposed tennis court lighting system plans to CalTrans for approval. 4. That the proposed use, as granted, will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 5, That the size and shape of the site proposed for the use is ac'equate to allow the full development of the proposed use, as granted, in a ma~ner not detrimental to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 6. That the Conditional Use Permit, as granted, and under the conc~itions imposed, will not be detrimental to tfie peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 7, That no one indicated their presence at said,buh?t~ hearing in opposition, and no correspondence was received in opPosition to ject petition. ENVIRGNMENTAL IMPACT REPORT FINDING; ~ That the Planning Commission recommends to the City Council that the subject project be exempt from the requirement to prepare an Environmental Impact Report, pursuant to the provisions of the California Environmental Quality Ac*_. PC75-50 . , NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant, in part, subject Petition for Conditional Use Permit upon [hc foiloa,- ino conditions which are hereby found to be a necessary prerequisite to *_he proposed use of thE subject property in order to preserve the safety and general :~elfare uf ;iic Citizens of the City of Anaheim: l. That trash storage areas shall be provided in accordance with approved plans on file with the office oT the Director of Public Works. 2. That fire hydrants shall be installed and charged as required and deter- mined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 3• 7hat subject property shall be served by underground utilities. 4. That sidewalks shall be instailed along Kraemer Place and La Mesa Street as required by the City Engineer and in accordance with staidard plans and speci- fications on file in the office of the City Engineer. 5• That drainage of subject property shall be disposed of in a manner satis- factory to the City En9ineer. 6. That street lighting facilities along La Mesa Street shall be installed as required by the Director of Public Utilities and in accordance with standard plans and specifications on file in the office of the Director of Public Utilities; and that a bond in an amount and form satisfactary to the City of Anaheim shall be posted with the City to guarantee the installation of the above-menti~~ned require- ments. 7. That the petitioner shall submit the proposed tennis court lighting system plans to CalTrans (California State Department of Transportation) for approval. 8. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 and 2; provided, ho~aever, that the proposed tennis facility shall,be constructed in accordance with the site developmeiit standards of the ML Zone. 9. That Condition No. 6, above-mentioned, shall be complied with prior to the commencement of the activity authorized under this resolution, or prior to the time that the building permit is issued, or within a period of one year from date hereof, whichever occurs first, or such further time as the Planning Commission or City Council may grant. 10. That Condition Nos. 1, 3, 4, 5, 7 and 8, abuve-mentioned, shall be complied with prior to final building and zoning inspections.
