PC75-88 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ANAHEIM THAT PETITION FOR RECLASSIFICATION N0. 74-75-31 BE APPROVED. WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Reclassification from CLYDE C. AND MAGDALENE N. CARPENTER, 292 Wilshire Avenue, Anaheim, California 92801 (Owners); LYNN E. THOMSEN, 710 North Euclid Street, N222, Anaheim, California 92801 (Agent) of certain reai property situated in the City of Anaheim, County of Orange, State of California, described as: The East 120 feet of Lot 25 of Tract No. 3372, as sf~own on a map recorded in book 126, pages 18 and 19 of Miscellaneous Maps, records of Ora~pe County, California; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on April 28, 1975, at 1:30 p.m., notice of said pubiic hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commissio~, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at satd hearing, does find and dttermine the following facts: l. That the petitioner proposes reclassification of the above-described property from the CL (COMMERCIAL, LIMITED) to the RM-2400 (RESIDENTIAL, MULTIPLE- FAMILY) ZONE. 2. That Che Anaheim General Plan designates the subject property for general comnercial and/or medium density residential uses. 3. Thrt the proposed reclassification of subject property is necessary and/or desirable for the orderly and proper development of the community. 4. That the proposed reclassification of subject property does properly relate to the zones and thetr permitted uses locatly established in close proximity to subject property and to the zones and their permitted uses generally established throughout the community. 5, That the proposed reclassification of subject property requires the dedication and improvement of abuttirg streets a~d alleys in accordance with the Circulation Element of the General Plan, due to the anticipated increase in traffic which will be generated by the intensification of land use. 6. That no one indicated their presence at said public hearing in opposition, and no correspondence was received in opposition to subject ;~tition. ENViRONMENTAL IMPALT REPORT FINDING: lhat the Planning Commission recommends ta the City Council that the subject project be exempt from the requirement to prepare an environmental Impact Report, pursuant to the provisions of the California Environmenial Quality Act. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby recommend to the City Council of the City of Anaheim that subJect Petition for Fleclassification be approved and, by so doing, that Title 18-Zoning of the Anahe:im Municipal Code be amended to exclude the above-described property from the CL {(;OMMERCIAL, LIMITED)ZONE and to incorporate said described property inta the RM-21~00 (RESIDENTIAL, MULTIPLE-FAMILY) ZONE upon the ~following conditions which arQ heret~y found to be a necessary prerequisite to the proposed use of subject property in or•der to preserve the sefety and general weifare of the Citizens of the City o~f Anahe:im: (I) That the owner(s) of subject property shall pay to the City of Anaheim the sum cf 60C per front foot along Catalpa Drive for tree planting purposes. RESdLUTiON N0. PC75-88 , J ~ ~ (2) That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. (3) That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. (4) That subject property shall be served by underground utilities. (5) That a six-foot masonry wall shall be constructed along the north and west property lines. (6) That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. (7) That the owner(s) of subject property shall pay to the City of Anaheim the appropriate park and recreation in-lieu fees a; determined to be appropriate by the City Council, said fees to be paid at the time the building perrtiit is issued. (8) That appropriate wat.~ assessment fees as determined by~ the Director of Public Utilities shall be paid to the City of Anaheim prior to t:he issuance of a building permit. (9) That subject property shall be dr.veloped substantially in accordance with plans and specifications on file with the City of Anaheim markeci Exhibit Nos. 1, 2, and 3. (i0) Prior to the introduction of an ordinance rezoning sub_ject property, Condition No, l, above-mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within o~e year from the date hereof, or such further tin~ as the City Council may grant. (11) That Condition Nos. 2, 4, 5, 6, and 9, above-mentioned, shall be complied with prior to final building and zoning inspections.
