PC 75-90' ,... ~ ~ RESOLUTION N0. PC75-90 A RESOLUTION OF THE CITY PLANNING COMMISSION Of THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2694 BE GRANTED. WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance from HOWARD FARRAND, 522 South Rose Street, Anaheim, California g2805 (Owner) of certain real property situated in the City of Anaheim, County of Orange, State of California described as: The south 69.00 feet of'Lot 16 and the North 63.50 feet of Lot 15 of Tract No. 3251> as shown on a map recorded in Book 100, pages 17 and 18 of Miscellaneous Maps, records of said ccunty; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on April 28, 1975, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed variance and to investigate and make find- ings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the follo~,ring facts: l. That the petitioner requests the following waivers from the Anaheim Municipal Code, to permit the outdoor storage of shipping containers: a. SECTION 18.61.063.013 - Minimum front setback. ( feet required; , none proposed) b. SECTION 18.6i.068.030 - Required enclosure of outdoor uses. (6-foot masonry wall required; none proposed) 2. That Waivers 1-a and 1-b, above-mentioned, are hereby granted for a period of two (2) years, subject to review and consideration for an extension of time, upon written n,quest by the petitioner. 3. That the purpose of establishing the time limit for this variance is to give the petitioner time to eliminate the need for the above-mentionec~ waivers. 4. That there are exceptional or extrdordinary circumstances or conditions applicable to the p~aperty involved or to the intended use of Yhe property that do not apply generally to the property or class of use in the same vicinity and zone. 5. That the requested variance as granted is necessary for the preservation and enjoyment ofi a substantia) property right possessed by other property in the same vicinity and zone, and denied to the property is question. 6. That the requested variance as granted will not be materially detrimental to the public welfare or injurious to the property or improvements ir~ such vicinity and zone in which the property is located. 'J. That nu one indicated their presence at said publit hearing in opposition and no correspondence was received in opposition to subject petEtion. ENVIRONMENTAL IMPACT REPORT FINDING: That the Director of Development Services has determinad that the proposed activity falls within the definition of Section 3.01, Class 5 of the City of Anaheim Guidelines to the Requirements for an Environrnental Impact Report and is, therefore, categorically exempt from the requi;~ment to file an E~R, RESOLUTIOiJ N0. PC75-90 •Y ~ ~ NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Variance, upon the following conditions which are hereby found to be a ~ecessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the Cit.y of Anaheim: (1) That subject property shall be developed substantially in accordance wi,*.h plans and specifications on file with the City of Anaheim marked Exhibit No, l. (2) That a tim~: limitation of two (2) years shall be granted for this variance and, upon written request by the petitioner, an additional period uf time may be granted upon approval by the Planning Commission and/or City Council; provided, however, that the petit.ioner shall make an effort to eliminate the need for the requested waivers during the two-year period.
