WHEREAS. on June 25, 1974, the City Council of the City of Anaheim approved Conditional Use Permit Plo. 1462 to establish on-sale liquor in each of four resraurants and to estaLlish a 1,200-seat tripbe theatre on a portion of the subject property con- sisting of a~nprdxiMately 13.6 acres, located at the northwest corner of La Palma Avenue and TQagnol~a Avenue, havimg approximate frontages of 1,270 feet on the north side of La Paima Aven'ue and 325 `eet on the west side of Magnolia Avenue; and WHEREAS, Conditiona4 lise Permit No. 1462 was approved subject to certain con- ditions being met, includirg "That subject property sl~all be developed substan[ially in acco•rdance ~aith p1ans and specificattons on file with the City of Anaheim..."; and 411~EREP.S, Conditional Use Permit Plo. 1~162 was approved in conjunction with Reclassification No. 73-7~+-55 approving rezoning from the ML (Industrial, Limited) ~one to the CL (Lommercial, Limited) Zone; and WHEREAS, on December 22, 1975, the Anaheim City Plannina Commission considered revised plans submitted in connection with Conditional Use Permit No. 1462 and determined that the proposed plans were not in substantial ~conformance with the original approval of said use permit and, therefore, the pians wer~ subject to a public hearinct; and lJF!FREAS, the Anaheim City Planning Commission did hold a public hearing at the CiCy Hall i~ Lhe City of Anaheim on January 19, 1976, at 1:3~ p.m., notice of sai.d public kiearing having been duly aiven as required by law and in accordance with the provis"ions of the Anaheim Municipal Code,to hear and consider evidence for and against said proposed revised plans submitted in connection with Conditional Use Permit No. 1462, and to inyestig~te and make findings and recommendations in connection therewith; and WtiEREAS. s~id Commission, after due inspection, investigation and study made by itself and iti~ its behalf, and after due consideration of all evidence and reports offered at said public hearing, ~OLS HEREBY FIPiD: (1) That the petitioner proposes to establish two resC9urants with on-sale liquor on two parcels of an 11-lot commercial subdivision, and said pro- posed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. (3) That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the Feace, health, safety, and general welfare of the Citizens of the City of Anaheim. (4) That the granting of the Conditional Use Permit under the conditions imposed oiill not be detrimental to the peace, health, safety, anJ general welfare of the Citizens of the City of Anaheim. (5) That no one indicated their presence at said public hearinq in opposition; and no correspondence was received i~ oppositton to subject petition. (6) That Environmental Impact Report tJo. 123 pertaining to development of the subJect property was certified by the City Council on June 25, 1974~ and no further documentation is deeR~~ to ~e reG~ired, based upon the p~oposal as submitted. NOb1, THEREFDP.E, BE IT P.ESOWED that the Anaheim City Planning Commission does hereby grant Conditional Use Permit tdo. 146z (Readvertised), upon the following con- dition~ which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safeTv and general welfare of the Citizens of the City of Anaheim: . ~ ~ ~ 1.
