IJHEREAS, the Anaheim City Planning Commission did receive a verified Pr.tition for liariance from TNF~DORE APID DEANHA TQDQROFF, 925 N, Anaheim Boulevard, Anaheim, California 92~OS (Owners); AtJN T, MADISON, 6QQ S, Harhor 9o•;;evard, Anaheim. California q2$05 (Agent) of certain real property situated in the City of Anaheim, County of Oran~e, State of California ~lescribed as: Lots ~ and iQ in Block B of Tract No. 143, in the City of Anaheim, County of Oranae, State of California, as per map rocorded in Book 11, Page 3R of Miscellaneous Maps, records of said County. WHEREAS, the City Planning Comnission did hold a publ?c hearing at the City Hall in the City of Anaheim on Au9ust 2, 197~, at 1:3n p,m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of che An~heim 1lunicipal Code, Chapter 1f3,~3, to hear and consider evidence for and against sai~l propnsed variance and to investigate and make findinas and recomnendations in connection therr:t•~ith; and WIIFREAS, sair! Commission, after due inspection, investigation and study ma~1e by itself and in its behalf, and after due consideraCion of all evidence and reports offered at said hearing, rloes find and determine the following fact:: 1. That thc petitioner praposes the follaiing waiver from the Anaheim Hunicipal Code, to le~ally establish two (2) autdoor automobile hoists: SECTI011 18.~•5.~30 - Permitted accessor uses and structures. Outdoor automobile hoists not permittecl) 2. That [he ahove-mentioned waiver is hereby granted for a time period to expire April 22, 1977, sai~i er.piration date corresponding with the tir~e limitation grant~d for Variance No. 2~~~3 whici~ permitted the ex.isting transmission and automobile repair aiork facility at the subject service station site; and that the time linitaCion est~blisheci for this variance shall be subject to review and consideration for extension of time baseJ upon the status at the ti~e~e of the proposed wiciening of La Palna Avenue ancl M aheim Boulevard, in which event the subject property may he required to be de~~eloped in conformance with the site developrr~cnt standards of the C~ Zone and the size and shape of the property may then not be suitable for the proposed iase. 3. That there are exceptional or extraordinary circumstances or conditions applicable Co the property involved or to the intended use of the property that do not apply ~enerally to the property or class of use in the same vicinity and zone. ~~. That the requested variance is necessary for the preservation and enjoyment of a substantial pr~perty right possessed by other property in the same vicinity and zone, and denied to the property in question. 5. That the requested variance will not be materially detrimental to the public welfare or in,jurious to the property or imprnvements in such vicinity and zone in which the property is located. 6. That no one indicated their presence at said public hearing in opposition; and no correspon~lence was received in opposition to the subject peCition.
