P,all Roarl, Anaheim, California 9280~~ (Qwners) of cer*.ain real property situated in the City of /lnaheim, County of Orange, State of California described as: That portion of the Plorth half of the Plortheast quarter of the tlortheast quarter of the PJortheast quarter of Section 23, Tovmship 1E South, Range 11 4lest, in the Rancho Los Coyotes, in the City of Anaheim, County of Orange, State of California, as per map recorded in book ,1, page 11 of Miscellancous Naps, in the office of the county recor~les• of said county, sho~•m as Parcel 1 on a Parcel !~ap filed in bool: 71, pages 23 and 24 of Parcel Maps in said county recorders office. blIIEREAS, the City Plannin9 Commission did hold a puhlic hearing at the City Hall in the City of Anaheim on August 16, 1976, at 1:30 p.m.y ~otice of said public hearing having been duly given as required by lavr and in accordance with the provisions of the Anaheim tlunicipal Code, Chapter 1A.03, to hear and cnnsider evidence for and agatnst said proposed conditional use and to investigate and make findings and recommendations in connection there~•rith; and IJIfEREAS, said Commission, a`ter due inspection, investiqation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: t. That the proposed use is properly one for which a conditional use permit is authorized by Code Sectinn 1°,1111.QSD.~50, to wit: permit a veterinary hospital in the CL (COMIIERCI~L, L1~11TED) ZONE. 2. That the petitioner stipulated to constructing a 6-foot hiah masonry wall along the v~est property line, or to post a bond in an amount and form satistactory to the City Attorney's Office for the construction of said :~all; and in the eveiit that the petitioner elects to post a bond in lieu of constructing the wall prior to final building and zoning tnspections, tlis bond shall become due and Lhe wajl constructed within one year of the date of this resolution, unless an extension of time is granted by the Planning Commission. 3. That the proposed use will not adversely affect the ad_joining land uses and the groo~th and development of the area in which it is proposed to be lncated. 4. That the size and shape of the site proposed for the use is adequate to allo~+ the full development of the proposed use in a manner not detrimental to c_'ne particular area nor to the peace, health, safety, and generai welfare of the Citizens of the City of Anaheim. 5. 7hat the 9ranting of the Conditional Use Permit under the conditions ~mposed, if any, will not be detrimental to the peace, health, safety and general welfare of the Citize~s of the City of Anaheim. EPIVIRONNENTAL I!1PACT REPORT FIFIDINCs That the Director of the Planning Department as etermined *_hat t e propose activity falis a~ithin the definition of Section 3.fl1, Class 1, of the City of Anaheim fuidelines to the Requirements for an Envir~nmental Impact Report and ls, therefore, categorically exempt from the requirement to file an EIR. t~Ol•J, THEREFORE, BE IT RESOLVED that the Anaheim City Pla.nning Commission does hereby 9rant subject Petition for Conditional Use Permit, upon the followfng conditions which are hereby found to be a necessary prerequlsite to the pruposed use of the subject property in order to preserve the safety and general weifare ~f the Citizens of the City of Anaheim: t.
