WHEREAS, the Anaheim City Planning Commission did receive a vertfied Petition for Conditional Use Permit from THE 701JN TOUR FIIN BUS COMPANY, IPIC., 3~4 Katella Way, Anaheim, California 92802 (Owner) of certain real property siCuated in the City of Anaheim, County of Orange, State of Californi~ described as: Lot 9 and an und~vided one-fortieth interest in Lot 3 and an undivided one- iwentieth intcrest in Lot 22 of Tract No, 4R'8, Berger Half-Acres, as shown on a Map recorded iri book 19, page 24 of Miscellaneous Maps, records of Orange County. California. WHEREAS, the City Planning Commission did hold a public hearing at the Ctty Hall in the ~;~~:y c:f Anaheim on August 16, 1976, at 1:30 p.m., notice of said public hearing having t~een auly 91ven as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18,03, to hear mrtd consider evidence for aric against said proposed conditional use and to Investi~ate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, aft.cr d~e inspection, investigatlon and study made b} ' 91f and in its bPhalf, and after due consideration of all eviden~e and reoorts ot~ :~i at said hearing~ does find and detzrmine the following facts: 1. That tne proposed use is properly one for ~ahich a conditional use permit is authorized by C9de Section '18.21.05~.35~, to wit: permit a bus terminai in the RS-A-43,000 (RESIDENTIAL/AGRICULTURAL) Z~NE. 2. That the proposed use, an expansion of the existing bus terminal, is hereby granted for a period of one (1) year, sub)ect to review and consideration as to whether the use has been detrimental to the area. 3. That the petitioner stipulated to constructing an eight-foot (8 ft.) high masonry wall along the westerly property line ad)acent to the mobile home park. 4. That, for the protection of the adjacent mobtle home park residents, a ten-foot (10 ft.) wide, heavily landscaped, buffer strip shall be provided along the westerly property iine, plans for said landscaping to b~e submttted to the Planning Department for approval. 5. Thak, for the further protection of the adJacent mobile home park residents, no storage, parking, or other placement of buses shall he permitted within fifty feet (50 ft.) of the westerly property line. 6. That the petitioner stipulated that approximately one-half of the subJect property to be used for driveways, storage, maintenance and parking areas will be paved as soon as possible since the subJect use ts currently ~n existence, and that the remainder of the property wiil be paved as soon as econamically feasible. 7. That the proposed use, as granted, will not adversely affect the adjoining land uses and the growth and development of the area in which lt is proposed to be located. 8, That the size and shape of the site proposed for the use. as granted, is adeq'uate to allow the full development of the proposed use ir~ a manner not detrimentai to the particular area nor to the peace, health. safety. and general welfare of the Citizens of the City of Anaheim. 9, That the granting of the Conditiona~ Use Permit under the conditions imposed, will not be detrimental to the peace, hea~th, safer.y and general welfarc~ of the Citiz~ns of the City of Anaheim. 10. That no one indicated their presence at said public hearing in opposition; and that one (t) letter was received in opposition to sub)ect petition. RESOLUTIOM N0. PC76-156 ~ ~ ENVIRO~~MENTAL IMPACT REPORT fiNDiNG: That the Anaheim City Planning Commission does hereby recommend to the City Council of the City of Anaheim that the subJect pro.Ject be exempt from the requirement to prepare an environmental impact report, pursuant to the provisions of the California Environmental Quality Act. NOW, THEREFQRE, BE IT RESOLVED that the Anahein City Planning Commission does hereby grant subject Petition for Condittonal Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject properxy in order to preserve the safety and general welfare of the Citizens of the City of Anahetm: t. That all engineering requirements af the City of Anaheim along Mountain View Avenue, including preparation of improvement plans and installation of all improvements such as curbs and gutters, sidewalks, street gradin9 and paving, drainage facilities, ur other appurtenant o-~ork, shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the ofTice of the City Engineer; that street lighting facilities along Mountain View Avenue shall be installed as required by the Girector of Public Utilities and in accordance with standard plans and speclfications on fite in the office of the Director of Public Utilities; and/or that a bond, certificate of deposit, letter of credit, or casli, in an amount ard form satisfactory to the City of Anaheim~ shall be posted with the City to g~arantee the installation of the above-mentioned reauiraments. 2. That the owner(s) of sisbJect property shall p~y tc the City of Anaheim the sum of sixty cents (6CC) per frant foot along Mountain View Avenue for tree planting purposes. 3. That subject property shalt be served by underground utilities. 4, That drainag~ of suhJect property shall be disposed of in a manner satisfactory to the City Engineer. 5, That trash storage areas shall be provided in accordance with approved plans on fEle with the office of the Director of Pubtic Works. 6. That any parking, storage or other outdoor area lighting proposed shall be down-lightin9 and shall be directed away from the property lines to protect the adjacent residential uses. 7. That the sub)ect property shall be devetoped subs'antialiy in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Plo. 1; provided, however, that a ten-foot (10 ft.) wide heavily landscaped buffer strip shall be provided along the westerly property line and plans for said landscaping shall be submitted to the Planning Department for approval; that an eight-foot (8 ft.) high masonry wall shall be constructed alon9 the westerly property line, as stipulated to by the peti[ioner; and that the approximat~_ly one-half of the subject property to be used for driveways, storag~. maintenance and parking areas shall be paved as soon as possible (and the remainder of the pr~~perty shall be paved as soon as economically feasible), as stipulated to by the petii•ioner. 8. That Cond;~ton Nos. 1 and ?, above-mentioned~ shall be complied with prior to the commencement of the activity a~athorized under this resolutfon, or prtor to the time that the buildtng permit i~ issued, or withtn a pertod of one year from date hereof, whichever occurs first. or such further tlme as the Planning Commi~sion and/or City Council may grant. 9. That Condition Nos. 3, 4, 5, 6, and 7, above-mentioned, shall be complied with prior to final building and zoni~g inspections. 10. That, in order to determine whecher any adverse effects will result from the 3ranting on the proposed use of the subJect property, the Planning Commission grants said use for a period of one (1) year, after which ttme and upon written request by the petitioner, consideration may be given as to whether the use should be er.tended. -2- RESOLUTION N0.
