WHEREAS, the City Planntng Commission did hold a public he~rin9 at the City Hall in the City of Anaheim on August 3~, 1976, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and c~nsider evidence for and agai~st said proposed variance and to investigate and make findtngs and reconmendations in connection therewith; and WHEREAS, said Commisslon, after due inspection, investigatinn and study made by itse'!f and in its behalf~ and after due consideration of all evidence and reports offered at said h_aring~ does find and determine the following facts: 1. That the petitioner proposes the following waiver from the: Anahetm Mu~iciF;al Code, to establish a 64-lot, RS-HS-t0,00Q(SC) subdivision: SECT~ON 18.24.065.010 - Re uirement that all tots rear on arterial highways, side-on and 1 ront-on lots proposed) 2. That the above-mentioned waiver ts hereby granted on the basis that a hardship exists due to the topography and size and shape of the subJect property and~ furthermore, that similar waivers have been previously granted. ' 3, That there a~c~ exceptional or extraordinary circumstances or conditions ~pplicable to the property ircvolve4 or to the intended use of the property that do not apply generally to the proH~rty or class uf use in the same vicinity and zone. 4. ENVIRONMENTAL IMPACT REPORT FINDING: That Environmental Impact Report No. 185 (supplementing Master EIR No. 0, having been constdered this date by the Anaheim City Plarning Commisslon and evidence, both written arvd oral. liaving been prepared to supplement said draft F_!R No. 185, the Ptanning Commisslon believes that said draft EIR No. 185 does conform to tha City and State GuTdelines and tlie State of Californla Environmental Quality Act and, based upon such informatlon. does hereby recommend to the City Council that they certify satd EIR is In compliance with said Envtronmental Quality Act. NOW~ THEREFORE, BE IT RESOLVE6 that the Anaheim City Planning Commission does hereby grant subJect Petition for Variance, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subJer,t property in order to preserve the safe~y and general welfare of tha Citizens of the City of Anaheim: RESOLU'~ION N4.
