Dox 937, Anaheim, California 92t305 (Agent) of certain real property situated in the City o` Anaheim, County or Orange, State of California, described as: The (Jorth 434.00 feet of the followin9: aeginning at the Southwest corner of the West half of the Southwest quarter of tlie Southeast quarter of Section 12, Township 4 South, Ran9e 11 blest, in the Rancho Los Coyotes as per man recorded in book 51, page 11, fliscellaneous hlaps, in the office of the county recorder ofi said county, running thence North along the center of the road f74 feet; thence East 33t? feet; thence ~outh G74 fe~t; thence 4lest 33~ feet to the point of beqinn~ng. 1411[REAS, the City Planning Commission did hold a oublic hearing at the CitY Ilall in the City of Anaheim on February ?, 1976, at 1:30 p.m., notice of said .public hearing having been duly 9iven as required by law and in accordance with the provisions of the Anaheim P1unicinal Code, Cha~ter 1a.03, to hear and consider evidence for and against said proposed conditiona'1 use and to invesi:i~ate and make findings and recommendations in connection theret~ith; and W1IEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration o` all evidence and renorts offered at said hearing, does find and determine tlie following facts: 1. 7hat the proposed use is properly one for which a conditional use perMit is autharized by Code Sections ?~3.44.050.10Q and 13.nn,050.17Q, to wit: permit an apartment complex for tiie elderly ~~~ith waiver of: SECTION 1II.06.060.026G - Minimum number o~F arkin snaces. (8?. spaces re~uired; 39 spaces proposed. 2. That the above-mentioned waiver is hereby 9ranted on the basis that the Planning Commission has granted similar waivers previousl.y for apartment complexes for the elderiy because it has been shown such housing comoiexes do not ~enerate as nany vehicles as typical apartment complexes, and the petitioner indicated there is adequate open space on the subject property for expansion of the parking areas if a need arises. 3. That the proposed use is hereby granted in concept, subject to,the stipulation of the petitioner to submitting revis~d nlans increasing the setback betvieen the proposed residential struc±ure and the adjacent single-family and raultiple-family developments to the north and nor~heast and, alsa, qrovidincl a landscaped buffer in said setback to screen the oroposed use from said adjacent single-family and multiple-family residential uses; said revision to indicate a relocaxion of the proposed :^esidential siructure a~proximately 30 feet to the south to lessen the impact of the proposed 3-story building on the adjacent residential uses and an adjustment of the parking area locations, as needed; and, furthermore, said revised plans shall be submitted to the Plannin9 Commission for review anrl approval prior to the issuance of a building permit. 4, That the proposed use, as granted, ti~~ill not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 5. That the size and shape of the site proposed for the use is adequate to allow the full developMent of the proposed use, as granted, in a manner nnt detrii~l~ntal to the particular area nor to the peace, health, safety, and ~eneral ~aelfare of the Citizens of the City of Anaheim. 6. ihat the Conditional Use Permit as granted and under the conditions imposed will not be detrimental to the peace, health, safety, and general welfare of tlie Citizens of the City of Anaheim. EilViHON~~1Ei~TAL Ii~1PACT REPORT FIIJUII9G That the Anaiieim City Planninq Commission does herebY recommend to tlie Cit.y Council of the Cit,y of Anaheim that the subject project be exempt from the requirements to prepare an environmental impact renort, Pursuant tc the provisions of the California Environmental Quality Act. i~OtJ, TIiEREFORE, BE IT P.ESOLVED that the Anaheim Cit,y Planning Com~ission does hereby grant subject Petition for Conditional Use Permit, uaon the folloviing conditions tvhich are hereby fnund to be a necessary prerequisite to the oronosed use of the subject propert,y in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That all engineering requirements of the City of Anaheim, along Dale llvenue including preparation of improvement plans and installation of a11 improvements such as curbs and gutters, side~•ialks, street ~rad;ng and navin~, drainage facilities, or otVier appurtenant work shall be complied ~•~ith as required by the City [ngineer and in accordance with standard ~lans and soecifications on file in the office of the City ~:ngineer; that street lighting facilities along Dale Avenue sha11 be installed as required by the Director of Public Utilities, and in accordance witfi standard plans and specifications on file in the Office of the Director of Public Utilities and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted wi~th the City to 9usrantee the installation of tYie above- mentioned requirements. 2. That the o~•mer(s) of subject property shall pay to the City of Anaheir~ the sum of GOF per front foot along ~ale Avenue for tree nlanting ~urooses. 3. That trash storage areas shall be provided in accordance with aoproved plans on file ~-iith the Office of the Director of Public lJorks. 4. That fire hydrants shall be installed and charged as renuired and determined to be necessary by the Chief of the f•ire Department prior to cor!mencement of structural framing. That subject property shall be served by underground utilities. 6. That drainage of subject pr~oerty sha17 be disnosed of in a manner satisfactory to the Cit,v Engineer. 7. In the event that subject property is to be divided for the purpose of sale, lease, or financing, a parcel map, tn record the anproved division of subject oroperty shall be submitted to and aporoved by the ~ity of Anaheim ancl then be recorded in the office of the Orange County Recorder. 3. That the ovmer(s) of sub9ect property shali pay to the City of Anaheim the appropriate park and recreation in-lieu fees as determined to be anprooriate by the City Council, said fee~ to be paid at the time the buildin9 permit is issued. 9, That appropriate water assessment fees as determined by the Director of Publ~c Utilities shall be paid to the Gity of Anaheim prior to the issuance of a building permit. 10. That subject qroperty shall be developed subs~antially in accordance with plans and specifications on file v+ith the City of Anaheim marked Exhibit Plos. 1, 2, 3, and 4; provided, ho~~~ever, that revised nlans shall be submitted for Planninn Cominission approval prior to the issuance of a building perm~t, as stipulated to by ttie petitioner; and said plans shall indicate relocation of the proposed apartment building approximately 30 feet to the south, and shall provide a landscaoed buffer area along tlie north and northeast prooerty boundaries, and, furtherr~ore, the narking area locations shall be adiusted to accommodate the foregoi~g. 11. That Condition f~os. 1, 2. and 7, above-mentioned, sha11 be comolied with prior to the comnencement of the activity autharized under this resolution, or prior to the time that the building oermit is issued, or ~aithin a neriod of one year fron date hereof, whichever occu~~s first, or such further +.ime as the Plannin~ Commissior and/or City Council may grant. _p_ RESOLUTIOtd N0.
