WHEREAS, the City Planning Commission did hold a public hearing at the City
Hall In the Ctty of Anahelm on 5eptember 27, 1976~ at 1:30 p.m,~ natlce of said
publfc h~:aring having been duly gtven as required by law and in accordance with the
provislons oF the Anahelm Municipal Cede, Chapter 18,03, to hear and consider
evidence for and against said proposcd conditional use and to investigate and make
firidings and recommendatlons ln connectlon therewiih; and
WHEREAS, saic~ Commisslon, after due inspection, investigation and study made
by Itself and fn its behalf, and after d~~ consideration of all evidence and reports
offered at said hearing~ does find and determine the following facts:
1. That the proposed use is properly one for which a conditlonal use
permit is authorized by Code Section 1A,44,050.010, to wit: permit on-sale beer and
wine in a proposed restaurant In the CL (COMMERCIAL, LIMITED) ZQNE.
7.. That the petitioner stipulated that the beer and wine will be sold in
conJunctlon wlth the serving of ineals only.
3. That the proposed use will not adversely affect the adJointng land uses
and the growth and development of the area In which it is proposed t~ be located,
~i, 7hat the. slze and shape of the site proposed for the use is adequate tu
aitow the full development of the proposed use in a manner not datrimental to the
particular area nor to the peace~ health, sa4ety, and gener~l welfare of the Citizens
of the City or Anahelm.

f:NVIRONMENTAI IMPACT REPORT FI"lDING: That the Dtrector of the Planning
Department as determ(ned t at the proposed activity falls within th~ deflnitlon of
Section 3.01, Clas~ 1~ of the City of Anaheim Guideline.s to the Requirements for an
Environmental Impact Report and is, therefore, categorically exempt from the
requtrcmcnt to flla an EIR.
fIOW, 7HEREFORE, BE IT RESOLVED that the Anaheim City Planning Commisslon
does hcrei~y grant subJect Petl~tlon for Conditlonal Use Permit, upon the foltowing
condttlon•; whlch arc hereby f~~und to be a necessary prerequisite to the proposed use
of the sul~Ject property ln ord~er to preserve the safety a~~d general welfare of the
Citlzens of the City of Anaheim:
t. ThTt subJecC proper.:y shail be developed substantlally in accordance
with plars and speciflcations ~on file with the City of Anaheim niarked Exhibit Nos, 1
and 2~ prtor to final buiiding and zoning inspections.
