THE OFFICE OF 711E COUNTY RECORDER OF SAID COU':TY. l~1HEREAS, the City Plannin9 Commission did hold a public hearing~at th~ GitS~ }iall in the City of Analieim on February 2, 1976, at 1:30 o.m., notice of said public hearing having been duly given as required by l~w and in accordance t~~ith tl~e provisions of the Anaheim htunicipal Code, Chapter 18.03, to hear and cons~der evidence for and against said proposed variance and to investiaate and make findings and recomrnendations in connection therewith; and l~!lIEREAS, said Commiss~ion, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reoorts offered at said hearing, does find and determine the following facts: 1. That the petitioner requests the follo~oing waivers from the Anaheim 14unicipal Code, to permit two (2) on-site tract signs: a. SECTION 13.05.072.010 -(~iaximum number of tract si ns. 1 nermitted; 2 pro~osed b. SECTIOi~ 18.05.072.022 - I4aximum sign area. (9G square feet permitted; 180 square feet prooosed) c. SECTIOW I8.05.072.0231 - 1laxirnum siqn hei ht. (14 feet oermitted; 16 feet oroposed 2, That the above-mentioned waivers are hereby granted for a time limitation of six (6) months, on the basis that the proposed signing consists of tvio single-faced tract signs and is for temporary advertisting for a net•~ly established condominium development, as stipulated to by the petitioner. 3. That the petitioner stipu1ated to the immedia~e removal of any banners or flags bein~ flown at the subject location advertising the subject development. 4. That there are exceptional or extraordinar,v circumstances or conditions applicable to the property involved or to the intended use, as qranted, of the property that do not apply ge~erally to the property or class of use in the same vicinity and zone. 5. That the requested variance, as granted, is necessary fcr the preservation and enjoyment of a siabstantial pro~erty right possessed by other property in the same vicinity and zone, and denied to the nroperty i~~ question. 6. That the requested variance, as granted~ 411~~ not be mater~ally detrimental to the public ~~+elfare or injurious to the property or improvements in such vicinity and zone in whic!~ the property is located. 7. That no one indicated their presence at said public hearin9 in opposition; and no correspondence was received in opposition to subject petition.
