WHEREAS, the Anaheim City Planning Commission did recelve a verified Petition for Vartance from FAM~LY HEALTH PROGRAM~ INC., 2925 Palo Verde, Long Beach~ LalifornTa 90815 (Owner) of certain real •property sltuated in the City of Anaheim, Cuunty of Orange, State of Californla described as: That portion of the Southwest quarter of the Southwest quarter of the Southwest quar*_er of Section 5, in Township ~+ South, Range 10 West, in the Rancho Los CoyoYes, City of Anaheim, as shown on a map thereof recorded in book 51, page 10 Miscellaneous Maps, records of said Orange County. described as follows: Parcel 1 as show~i on a Parcel Map recorded in book 45, Page 6 of Parcel Maps, records of Orange County, Califor~ia. WHEREAS, the ('ity Planning Commission did hold a public hearing at the Ctty Hall in the City of Anaheim on November 8, 1976, at 1:30 p.m., notice of said publtc hearing having been duly given as required by law and in accordance wTth the provisions o~ the Anaheim Municipal Code, Chapter 18.03. to fiear and consider evidence for and against said proposed variance and to investigate and make findings and recommendatians in connectlon therewiCh; and WHEREAS, said Commission~ after due InspectTon, investigation and study made by itself and in its behalf, and after due consideratlon of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the petitioner proposes the following waiver from the Anaheim Municipal Code, to expand a medical and dental office complex in the ML (INDUSTRIAL, LINITED) ZONE: SECTION 18.61.02Q - Permitted uses. (Medical and dental office complex not permitted) 2. That the above-mentloned watver is hereby granted on the basts that the proposal is to expand ar. existing use on the subJect property, said existing use having not been detrimental to the surrounding area, 3. That r.here are exceptlonal or extraordinary circumstances or cenditions applicable to the property involved or to the intended use of the property that do not appiy generally to the property or class of use In the same vicinity and zone. 4, That the requested vartance is necessary for the preservation and enJoyment of a substantlal proFerty rlght possessed by other property in the same vicinity and zone~ and denled to the property in qi:estion. 5. That the requested variance will not be materiaily detrtmental to the public welfare or InJurious to the property or improvements in such vicinity and zone in which the property is located. 6, That no one indicated thelr presence at said public hearing in oppositian; and that no correspondence was recelved in opposition to subJect petition. ENVIRONMENTAL IMPACT REPORT FINDING: That the Anaheim City Planning Canmission does ere y recommen to t e C ty Councit of the City of Anaheim that a negat(ve declaratlon from the requiremenY to prepare an envlronmental impact report be approved for the subJect proJect~ pursuant to the provlsions of the Callfornia Environmental Quallty Act. NOW, THEREFORE~ BE tT RESOi.VED that the Anaheim C1Yy Planning Commission does hereby grant subJect Petitlon for Varlance, upon the following conditions which are hereby found to be a necessary prerequlsite to the proposed use of tFi•a subJect property in order to preserve tht safety and general wel4are of the CttYzens of the City of Anaheim: 1.
