WH[REAS, the City Planning Cortimission did hold a puhlic hearing at the Clty {lall in the CiCy of Anaheim on December 6, 1976, at 1:30 p.m., notice of said pubitc hearing having been duly given as required by law and in accordance wlth the provisions of the Anaheim Municipal Code, Chapter 18,0},. to hear and consider evtdence for and against said proposed reciassification and to investigate and make findings and recommendations in connection therewith.; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at satd hearing, does find and determine the follawing facts: 1, That ttie Anaheim City Plannin9 Commission proposes a reclassificatlon of zoning on the above-described property from the Ca!~nty of Orange A1 District to the City of Anaheim RS-SOOQ (Residential, Sfngle-Family) ~ane. 2. That the Anahelm General Plan, as amended, desi,nates the subjc:c't property for low-medium density residential uses. 3, That the authorized agent for the owner of subject prot~erty was Fresent at said public hearing and indicated no objections to the proposal for rezoning. 4, That the subJect property consists of a small corner parcel which has restrlcted access to adjacent arterial hi9hways and is contiyuous to a larger parcel to the east and souCh upon which a sing!e-family development has been approved; and, therefore, the subject property should appropriately be developed with single-family residences. • ' RESOLUTI01! N0. PC76-256 ~ ~ 5. That the proposezi reclassification of subiect pro;r•ar~y is necessary and/or desirable for the orderly and proper development ~f the community. 6. That the proposed reclassification of subject property does properly relate to the zones and their permitted uses lecally established in close proximity to subject property and to the zones and their permitted uses generally establ(shed throughout t~ie community. • 7. That the proposed reclassificafion of subject property requires the dedicatio~ and improvement oT abutting streets in accordance with the Circulation Element of the General Plan, due to the anticipated increase in traffic which will be generated by the intensification of land use. 8. ThaC no one indicated their presence at said publtc heartng in opposition; and that no correspondence was received in opposition to subJect petition. . ENVIRONI1EIJTAL IMPACT REPORT FINDiNG: That the Anaheim Gity .Planning Commission does hereby recomnend to the City Council of the City of Anaheim that a negative declaration from the requirements to prepare an environmental impact report be approved for the su6ject proJect, pursuant to the provisions of the Galifornia Environmentai Quality Act. NOW, Tf1EREFORE, BE IT RESOLVED that the Anaheim City Planning Conunission does hereby recommend t~o the City Council of the, City of Anaheim that subject Petltlon for Reclassification be approved and, by so doing, that Title 18-Zontng of the Anaheim Municipal Code be amended to exclude the above-described property from the CQUI~TY OF ORANG[ A1 DISTRICT and to incorporate said described proper.ty into the CITY Of ANAII[It4 RS-5000 (RESIDENTIAL, SIPlGLE-FAM~LY) ZONE upon the fc:lowing conditions which are hereby found to be a necessary prerequisite to the prop~sed use of subject property in order to preserve the safety and general welfare of the CiCizens of the City of Anaheim: 1, That the owner(s) of subject property sh.~Sl deed to the City of Anaheim a strip of land 45 feet in width from the centerline of the street along Sunk(st Street and 53 feet in width from the centerline of thc s:reet along Ball.Road for street widenin~ purposes. ~ 2 That all engineering reguirements of the Cit,y of Nnaheim along Ball Road and Sunkist Street including preparation of improvement plans and installation of all improvements such as curbs and gutters, sidewalks, street grading and paving, drainage facilitles or other appurtenant work, shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; that street llghting facilities along Ball Road and Sunkist Street shall be installed as required by the Dtrector of Public uCi7~eies, and in accordance a~ith standard specifications on file in the Office oF the Director of Public Utilfties; or that a bond, certificate of deposit, letter of credit, or cash, in an amount and form satisfactory to the Cit; of Anaheim shall 6e posted with the City to guarantee the installation of the abov~:-mentioned requirements. 3, That the owner(s), of subject property shall pay to the City of Anaheim the sum of sixty cents (60C) per front foot alony Ball Road and Sunkist Street 4ur tree planting purposes. 4. That subject property shall be served by underground utilities. 5, That dratnage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 6. That the a+ner of subject property shall pay to the City of Anahelm the appr~priate park and recreation in-lteu fees as determined to be approprtate by the City Council, satd fees to be paid at the time the building permit is issued. 7, That these reclassification proceedings are granted subject to completion of annexation of subject property to the City of Anaheim. 8. That development of subject property shall be in accordance with Council Policy tVo. 547. pertaining to sound•attenuation for residential uses. -2- RESOLUTION N0. PC76-256 ~ ~ . 9. In the event subject properl:y is to be divided for the purpose of sale. lease, or financing, a parcel map, to r•ecord the approved division of, subJect property, be submitted to and anproved by the City of Anaheim and =hen be recorded in the Office of the Orange County Recorder. 10. Prlor to the introduction of an ordinance re~ontng subject property, Condition No. 7, above-mentioned, shall be completed. The .provisions or rights granted by this resolution shalt become null and void by action of ttie City Council unless said conditions are complied with within one year from the date hereaf, or such further time as the City Council may grant. • 11.
