Miecollansoue Maps, zecords o! ~~id Orangt Cuunt~• - WIIEREAS, the City Planning Commisslon dld hold a public hearing at the City Hall in the City of Anaheim on Decemher 6, 1!376. at 1:30 p.m., notice of sald public hearing having been duly given as requtred by law and In accordance with the provislons of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditlonal use and to lnvestigate and make f~ndings and recommendattons in connection therewith; and WHEREAS, safd Commission, after due inspection, investigation and study made by itself and i~ its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts; RESOLUTION N0, PC76-25g ~ ~ 1, That the proposed use is properly one for whlch a conditional use permit is authorized by Municipal Code Section 18.61.050.5~~, to wit: permit a lumber yard, wlth waivers of the following: a. SECT!ON 18.61.(164.07.0 - Maximum fence heiqht. (3~ inches permitted in ront setback; 12 ~eet proposed b, SECTiON 15.61.068.03~ - Reauired er~closure of outdoor uses. Stacked lumber p~oJecting abave fance heights prohibited) c, SECTIOPI 1II.61.06fi.05Q - Hinimum number of arking sqaces. 229 spaces requlred; 203 spaces proposed) 2, That Walver 1-a, above-menttoned, ls hereby granted on the basis tha~t the petitioner stipulated that the proposed six-foot high earthen berm between the proposed fence and the publtc right-of-way along Ball Road will he planted with trees and ground cover to effectively screen the proposed fence frcm Ball Road anQ~ therefore, will not be detrimerital to the area. 3, That Waiver 1-b, above-mentioned, is hereby granted on the basis that the stacked lumber will not be vtslble to either the eastbound or westbound traffic along Ball Road, as stipulated to by the petitioner. 4. That Watver 1-c, above-menttoned, is hereby granted on the basis that the request is minimal for the use. as proposed, and reflects future u~ilmate development of subJect property and, further, that the petitioner indicated that addttional parking could be provided on the subJect property as the need may arise. 5. That the petltioner stiputated that the ele.ctrnnically-operated gate at the westernmost driveway wilt be kept c~pen durin,q business hours to accomodate trucks entering the site. 6. That the proposed use will not adversely affect the adJoining land uses and the growth and development of the area In which it is proposed to be located. 7, That the size and shape of the slte proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health~ safety~ and general welfare of the Citizens of the City of Anaheim. 8. That the grantirg of the Conditional llse Permit under the conditions imposed, If any, will not be detrimental to the peac~~, health, safety and general welfare of the CiClzens of the City of Anahelm. 9, That no one indicated their presence at said puhlic hearing in opposition; and that no correspondence was received in opposition to the subJect petition. ~ ENVIROPJt1f.~lTAL IMPACT REPORT FINDIIIG: That the Anaheim City Planning Commission oes ere y recommen to t e C ty Council of the City of Anaheim that a negative declaration from the requireme~t to prepare an environmental impact report be approved for the subJect proJect, pursuant to the provlsions of the Californta Environmental Quality Act. NqW~ THEREFORE, BE ~T RESQLVED that the Anaheim City Planning Commission does hereby grant subject Petttion for Conditional Use Permit, upon the followinq conditions which are hereby found to he a^ecessary prerequlsite to [he proposed use of the sub}ect property in order to preserve the safety and gene~~l welfare of the Citizens of the City of Anaheim: 1, That the owner(s) of subJect property shall deed to the City of Anaheim a strip of land 53 feet in width from the centerline of the strcet along Ball R~ad for street o-~idening purposes. 2, That sidewalks shall be installed along Ball Road as requlred by the City Enyineer and fn accordance with standard plans and specificatlons on file in the Office of the City Engineer. 3, That street lighting facillties along e:-,11 RoaA shalt be installed as required by the Director of Public Utilities. and ln accordance with standard -2- RESOLUTI01~ N0. PC76-258 ' t ~ ~ specifications on file in the Office of the Direttor of Public Utilities; or ihat a bond, certificate of deposit. letter of credit, or cash, in an amount and form satfsfactory to the City of Anaheim shail be po:;ted with the City to guara~tee the installation of thc above-mentioned requirements. 4, That the owner(s) of subJect property shalt pay to the City a~ Anaheim the sum of sixty cents (6UC) per front foot along Ball Koad for t~ee planting purposes. 5, That trash storage areas shall be provided in accordance with approved plans on filE with the Off~ce of the Director of Public Works. 6, That fire hydrants shall be instal!ed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of scructural framing. 7, That subJect property shall be served L•y underground 4tilities. 8, That drainage of subJect proper*_y shall be disposed of in a manner sattsfactory to the City Englneer. 9, That appropriate water assessment fees as determined by the Director of Public Utilitles shall be paid to the Ctty of Anaheim prior to the lssuance of a huilding permit. 10, That subJect property shall be developed suhstanttally in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. i through 3; provided, howevcr, that the proposed fencc ln the required front yard shall be extended along the west property line so as to effectively screen the proposed storage from vic++ along Batl Road. ii, That Co~dltlon Nos. 1~ 3, and 4, above-mentioned, shall be compited with prior to the commencement of the activity authorized under ehis resolutlon~ or prlor to the time that the buitding permit is issued, or withln a period of one year from date hereof, aihichever occurs first, or such further time as the Plann!ng Commission and/or City Council may grant. 12. That Conditlon Nos. 2~ 5, 7, 8, and 10, above-mentioned~ shall be complled with prior to final building and ioning inspections. t;. That the electronically- operated gate proposed at the westernmost driveway alony Batl Road shall be kept open during business hours, as stipulated to by the petitioner.
