IJHEREAS, tlue City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on December 20, 1Q7P, at 1:30 p•m•, not.ice of sai~~ puhlic hearing having been duly given as require~i by law and in accordance with the provisions of the Anaheim Municipal Code, Ch~3pter 18.03. to hear and consider evidence for and against said proposed vartanus and to lnves:igate and make findings and r~commendations in connectin.~ therewith; amd lJ}1EREAS, sald Commission, after due inspection, irivrstigat~on and study made by itseif and in its behalf, and after due consideration of all aaidence and reports offered at said hearing, does find and determine the following fact<_~: 1. That the petitioner pr•oposes the f~llot~ing waiver from the Anaheir~ Municipal Code, to permit an existing illegal fenca: SECTION 18,34.064.U70 - Haximum fence heiqht. (9 foot 2 inch high chainlink ences existin~t permitted) 2. That the above-menttoneci waiver is hereby dented on the basis that the parking standards as applied to the suhJect property at the tims of conversion t~ a condominium proJect did not provide recreational vehicle storage spaces, and if such storage is needed, spaces should be provided in accordance with Che applicable zoning regulations; that the existing 9-faot, 2-inch fences were illeqally constructed without building permits and in violation of the Zoning Code; that the petitioner did not demonstrate that a hardship would be created if satd watver was not granted; that if said waiver were granted, a precedent would be set for future similar requests; ~nd that special and protected off-site parking lots are avatiable for parking of recreational vehicles. 3, ihat there are no e:~ceptional or extraordinary circumstances or conrlitions applicable to the property invoived or to the intended use of the pr~perty that do not apply generatly to the property or class of use in the same vicinity and zone. 4. That the requested variance is not neeessary for ihe preservation and enjoyment of a substantial property rlght possessed by other property in the same vicinity and zone, and denied to the property in question. 5. That the requested variance will be materially detrimental ta the public welfare or injurious to the property or improvements In sueh vicinity and zone in which Yhe property is located. 6. That one (1) persan appeared representing two (2) persons present at said publlc hearing in opposition; and that no correspondence was received in opposition to subject petition.
