A RESOLUTION OF THE CITY PLANNItIG CONMISSION OF THE CIiY OF At1.ANEIt1
THAT PETITION FOR VARIANCE N0. 27~36 BE G"1PITED.
tJfiEREAS, the City Plann9ng Commission of the City of Anaheim did receive a
verified Petition for Variance from tdILLIAt~ V. BOULTER, 7541 E. Paseo Laredo,
Anaheim, California 92807 (Owner) of certain real pronerty situa~ed in the City of
Anaheim, County of flrange, State of California described as:
Lot 31 of Tract No. 7730, as shown on a Man recorded in book 337, oaqes 44 to n7
bcth inclusive of Miscellaneous Maps, records of Oran9e County~ California.
WNEREAS, the City Planning Commission did hold a nublic hearing at the Cit.v
Hall in the City of Anaheim on March 15, 1376, at 1:3Q p.m., no.tice of said oublic
hearing having been duly given as required by la~~i and in accordance with the
provisions of the Anaheim Plunicipal Code, Chapter 18.03, to hear and consider
evidence for and against said prooosed variance and to investigate and make findinqs
and recommendations 9n connection therewith; and
WfIEREAS, said Commission, after due inspection, investigation and study made
by itself and in its behalf, and after due consideration of all evidence and reonrts
offered at said hearing, does find and determine the follo~•~ing facts:
1. That the petitioner requests the following waiver from the Anaheim
~4unicipal Code, to construct a block wall:

2. That the above-mentioned wativer is hereby granted on the basis that the
petitioner der~onstrated that a hardship would be created if said waiver were nat
granted, said hardshio being the detriment to the peace, health, safety and general
welfare of the Citizens of the City of Anaheim,
3. That there are excel~tional or extraordinary circumstances or conditions
applicable to the property involved or to the intend2d use of the property that do
not apply generally to the property or class of use in the same vicinity and zone.
4. 7hat the requested variance is necessary for the nreservation and
enjoyment ofi a substantial nroperty right possessed by other property in the same
vicinity and zone, and denied to the nronerty in question.
5. That the requested variance will not be materially detrimental to the
public welfare or injurious to the property or improvements in such vicinity and zone
in which the property is located.
6. That no one indicated their nresence at said public hearin~ in
opposition; and no correspondEnce was received in onnosition to subject netition.

That the Director of the Planning Denartment has determined that the
proposed activity falls within the def9nition of Section 3.0~, Class 3 of the City
of Anaheir~ 6uidelines to the Requirements for an Environmental Imnact Renort and is,
therefore, categorically exempt from the requirement ~o file an EIR.
NOIJ, TFIEREFORE, BE Ii' RESOLVED that the Anaheim City ?lanning Commission
does hereby grant subject Pet9tion for Variance, upon the folloviing condittons whtch
are hereby found to be a necessary prerequis9te to the proposed use of the sub3ect
property in order to preserve the safety and general welfare of the Citizens of the
City of Anaheim:
