That the proposed reclassification of subjec~ property is necessary and/or desirable for the orderly and propc:r develnpment uf the community. 4. ENVlRONMENTAL IMPACT REPORT FINDING: That Environmental impact Report No. 166, having been considered this date by the Anaheim City Planning Commission and evidence, bath written and aral, having been presented to supplement said draft of EIR No. 166, the Plannin9 Commission believes that said draft of EIR No. 156 does conform to the City and State Guidelines and the State of ~aiifornia Environmental Quality Act and, based upo~ such information~ does hereby recommend to the City Council of the City of Anaheim that they certify said EIR Is in compliance with said Environmental Quality Act. NOW, THEREFORE, BE IT RESOLVED tha~ the Anaheim City Planning Commission does hereby recommend Lo the City Councit of the City of Anaheim that subject Petition for Reclassification be approved and, by so doing~ that Title 18-Zoning of the Anaheim Municipal Code be amended to exclude the above-described property from the RS-A°43,OOO~SC) (RESIDENTIAL/AGRICULTURAL - SCENIC CORRIDOP, OVERLAY) ZONE and to incorporate said described property into the RS-5000(SC) (RESIDEP~TIAL, SIPJGLE-FAMILY - SCENIC CORRIUGR OVERLAY) ZONE upon the following cbnditions which are hereby found to be a necessary prerequisite to the proposed use of subJect property in order to preserve the safety and ge~eral welfare of the Citizens of the City of Anaheim: 1. That trash storage areas shall be provided in accordance with approved plans on f~le with the Office of the Director of Public Works. 2. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 3 That drainage of subJect property shall be disposed of in a manner satisfactory to the City Engineer. If~ in the preparation of the site, sufficient grading is required to necessitate a grading permit, no work on grading will be permitte~+ between October 15eh and April 15th unless all required off-site drainage facilities have been instailed and are operative. Positive assurance shall be provided the City that such drainage facilities will be completed prior to October 15th. Necessary right-of-way for off-site dralnage Pacilities shall be dedicated to the City, or the City Council shall have initiated condemnation proceedings thErefor (the costs of which shall be borne by the developer) prior to the commencement of grading operations. The required drainage facilities shall be of a size and type sufficier~t to carry runoff waters originating from higher properties through subject property to ultimate dtsposal as approved by the City Engineer. Said drainage facilities shall be the first item of constructions and shall be completed and be functional throughou: the tract and from the downstream boundary of the property to the ultimate point of di:,posal prEor to the issuance of any final building inspectio~s or occuparocy permits. Drainage districx ~~imbursement agreements may be made available to :h:: developers of subject property ,~on their request. 4. That grading, excavation, and a11 other censtrur.tion activities shall be conducted in such a manner so as to min~mize the possibility of any silt originating from this project being carried into the Santa Ana River by storm water originating from or flowing througl~ this proJect. 5, That the ow~ier of subject property shall pay to the City of Anaheim the appropriate park and recreation in-lie:~ fees as deternined to be appropriate by the CiC,• Council, said fec~:s to u~~ paid at the time the building permit is issued. 6. That a final tract map af subJect property shall be submttied to and approved by the Ctty Council and Yhen be recorded in the Office of the Oranqe County Recordery prior to the introduction of an ordinance rezoniny subJect property. The provisions or rights granted by this resol;,tion shall became null and void by action of the ~ity ~ouncil unless said condition is comp2ied with within ane year•fr~m the date hereof, or such further time as the City Council may grant.
