RESOLUTION N0. PC7G-54 ~ ~ WHEREAS, the City Planning Commission did schedule a public hearing at the City Hall in the City of Anaheim on March 15. 1976, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance -~ith the provisions of the Anaheim Municipal Code, Chapter 18.03. to hear and consider evidence for and a9ainst said proposed conditional use and to investigate and make findings and recorrrrendations in connection th~rewith; said public hearing having been continued to the Planning Cor.imission meeting of March 29, 1976; and . WHEREAS, said Commtssion, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of ail evidence and reports offered at said hearing, does find and determine the following Tacts: t. That the proposed use is properly one for which a conditional use permitis authorized by Code Section 18.27.050.060, to wit: permit a six-unit model home complex. 2. That the proposed ~se will not adversely affect the adjoining land us~s and the growth and development of the area in which it is proposed to be located. 3. That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. . 4. That the granting of the Conditional Use Permit under the conditions imposed, if any, will not be detrimental to the peace, health, safety and general weifare o` the Citizens of the City of Anaheim. 5. That one (1) person appeared at said public hearing in opposition; that one (1) person appeared in favor; and that one (1) letter was received in opposition to subject petiticn. ENVIRONMENTAL IMPACT REPORT FItJDING: That Environmental Impact Report No. 166, having been considered this date by the Anaheim City Plannin9 Commission and evidence, both written and orai, having been presented to supplement said draft of EIR No. 166, the Planning Commission believes that said draft of EIR t•!o. 166 does conform to the City and SCate Guidelines and the State of California Environmental Quality Act and, based upon such information, does hereby recommend to the City Council of the Ciiy of Anaheim that they certify said EIR is in compliance with said Environmental Quality Act. NOW, THEREFORE, B[ IT RESOLVED that the Anaheim City Planning Lommission does hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the pr<~posed use of the subJect property in order to preserve the safety and general welfare of tFe Citizens of the City of Anaheim. 1. That Crash storage areas shall be provided in accordance with ~pproved plans on file with the Office of the Director of Pubtic Works. 2. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chlef of the Fire Department prior to commencement of structural framing. • 3. That subject proparty shall be served by underground utilities. 4. That drainage of sub]ect property shall be disposed of in a manner satisfactory to the City Engineer. 5. That public utility easements shall be granted as required by the Director of Public Utilities. 6. That this Conditional Use Permit shall remain in full force and effect for a period of two (2) years from the date hereof or until all of the homes in Tract Nos. 921z, 9213. 9214 and 9215 are initially sold, whichever oceurs first, or such further time as the Plarrning Commission and/or City Council may grant. 7. That a bond in an amount and form satisfactory to the City of Anahelm shall be posted with the City to guarantee the removal of the models in the event the final maps of Tract Nos. 9212, 9213, 9214 and 9215 are not recorded~ said bonding to be complie~! w(th prtor to the commencement of the activity aathorized under this resolutton or prior to the ttme that th~ buil~ing permit is issued, or wtthin a period of one year from date hereof, whichever occurs first. or such further time as the Planning Commission and/or City Council may grant. . -2- RESOLUTION N0.
