PC76-65 A RESOLUTION OF TfiE CITY PLANNING COMMt5510N OF THE C1TY OF ANAHEIM RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ANANEIM TNAT PETITION FOR RECLASSIFICATION N0. 75-76-29 BE APPROVED. WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Reclassification from PACIFIC AMERICAN PROP., INC., 108R9 Wilshire Boulevard, Suite 1602, Los Angeles, California 9Q024 (Owner); VICTOR J. VIDAL, 11171 Brenda Lane, La Habra, California 90631 (Agent) of certain real property situated in Yhe City of Anaheim, County of Orange, State of California described as: That portion of Blocks "F" and "K" of the Kraemer Tract, as shown on a Map recorded in book 12, pages A7 and 88 of Miscellaneous Maps Records of Los Angeles County, California, described as follows: Beginning at a bolt marking the intersection of the center line of Crowther Avenue as laid out by the County of Orange, with the center line of Orangethorpe Avenue as established by the California State High~•~ay Division; thence from said bolt North 87° 15' 40" West 942.7~ feet along said center line of Crowther Avenue; thence South 2° OS' 20" West 326.50 feet to a point in the said center line of Orangethorpe Avenue; thence North 73° 34' 2~" East 44~i.3Q feet to the point of beginning. EXCEPTING THEREFROM that portion included in Bloc{: "K". Also exceptin9 therefrom the following: All that portion of said land tying Westerly of the following described line: Beginning at a point in the center line~of Orangethorpe Avenue, said point being distant South 73° 33' 2z" West 51~•53 feet from the center line intersection of Orangethorpe Avenue and Mill~r Street as shown on a Map recorded in book 16, page 36~ Record of Surveys of said Orange County; thence tJorth 2° 17' 21" East, 183.25 feet; thence North 17° 48' k3" East 119•3~ feet to a point on the center line of Placentia Yorba Boulevard (formerly Crowther Avenue), said point being distant South 87° 17' 28" East, 113.19 feet from the Northwesterly corner of the land described in said deed to the Anaheim Union Water Company~ and shown on satd map recorded in book 16, page 36, Record of Surveys of said Orange County. WNEREAS, the City Planning Commisston did hold a public hearing at the City Hall in the City of Anaheim on April 17, 1976, at 1:30 p.m., notice of said public hearing havtng been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and agalnst said proposed reclassification and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due tnspectlon, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the petitioner proposes a reclassification of the above-described property form the RS-A-43,000 (RESIDEIJTIAL/AGRICULTURAL) ZOWE to the CL (COMMERCIAL, LIMITED) ZONE. 2. That Che Anaheim General Plan designates sub,ject property for low- medium density residential uses. 3, That the proposed reclassification of suhJect property ts necessary and/or deslrable for tfie orderly and proper development of the community. 4. That the proposed reclassification of subJect property does properlY relate to the zones and their permitted uses locally established in close proximity to subJect property and to the zones and their permitted uses generally established throughout the community. 5, That the proposed reclassification of subJect property requires the dedication and improvem~nt of abutting streets in accordance with the Circulation Etement of the General Plan, due to the anticipated increase in traffic which will be generated by the intensification of land use. ENVIRONMENTAL 114PACT REPORT FINDING: That the Anaheim City Planning Commisslon does Fereby recoRmend to the City Councit that the subJect proJect be exempt from the requirement to prapare an environmental impact report, pursuant to the provisinns of the California Environmental Quality Act. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby recommend to the City Council of the City of Anaheim that subJect Petition for Reclassif{cation be approved and, by so dning, that Title 1R-Zoning of the Anaheim Municipal Code be amended to exclude the arove-dPscribed property from the RS-A-43,000 (RFSIDENTIAL/A6RICULTURAL) ZONE and to incorporate said descrihed property into the CL (COMMERCIAL, LIMITED) ZO!JE upon tlie following conditions wfiich are hereby found to be a necessary prerequisite to the proposed use of subJect property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That the owner(s) of subject property shall dced to the City of Anaheim a strip of land 45 feet in width from the cenCerline of the street along Crowther Avenue and 53 feet in width from ;he centerline of the street along Orangethorpe Avenue for street widening purposes. 2. That all en9ineering requirements of the City of Anaheim along Crowther Avenue and Orangethorpe Avenue, including preparation of improvement plans and installatTon of all improvenents such as curbs and gutters, side~aalks, street grading and paving, drainage facilities or other appurtenant worlc, shall he complied with as required• by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; that street lighting facilitles along Crowther Avenue and Orangethorpe .Avenue shall be installed as required by the Director of Public Utilities; and in accordance v,ith standard plans and specificaCions on fi•le in the Office of the Dirr.ctor of Public Utilities; or that a bond in an amount and form satisfactory to the City of Anaheim shall he posted with the City to 9uarantee the installation of the above-mr.ntioned renuirements. 3. That sidewalks shall be installed along ~liller Street as required by the City Engineer and in accordance with standard plans and specifications on file in the Offlce of the City E~gineer. 4. That the owner(s) of subJect property shall pay to the Lity of Anaheim the sum of 60 cents per front foot along Crowther Avenue, Orangethorpe Avenue, and Miller Street for tree planting purposes. 5. That trash storage areas sfiall be provided in accordance with approved plans on file wtth the Office of the ~irector of Public ':lorks. , 6. That fire hydrants shall he installed and charged as required and determined to be necessary by the Chief of the Fire Department Arior to commencement of structural framing. . 7. That subJect property shall be served by underground utilities. 8. That drainage of subJect property shail bc ~iisposed of in a manner satisfactory to the City [ngineer. 9. That appropriate water assessment fees a.s determined by the Director of Public Utilittes shall be pald to the City of Anaheim prior to the issuance of a building permit. ld. Prior to the lntroduction of an ordinance rezoning subJect property, Condition Nos. 1~ 2~ and 4, ahove-mentioned, shall be completed. The provisions or rights granted by this resolution shall hecome null and void by actton of the Ctty Council unless sald conditions are complied o-~ith within one year f;~;n the date hereof~ or such further time as the City Council may grant. il.
