WHEREAS, the City Planning Commisslon of the City of Anaheim dld receive a v~rified Petition for Reclassification from ANAHEIH UNION HIGH SCHOOL DiSTRiCT, ATTN: STANLEY F. LATTIMER, 501 Crescent Way, Anaheim, California 42R03 (Owner); PACESETTER HOMES, 4540 Campus Drive, Newport Beach. Californla 92660 and TAIT E ASSOC.~ INC.. 900 Orangefair Lane, Anaheim, California 92E~3 ~Agents) of certaln real property sttuated in the City of Anaheim, Couniy of Orange, State of California described as: Lots 15. 16 and the NorCh half of Lot 18 of Helen b Lynch's subdivision, in the City of AnaheTm, County of Orange, State of California, as shown on a map recorded in book 442, page 158 of Deeds, records of Los Angeles County~ California. EXCEPTING THEREFROM the Easterly 3~.00 feet of said Lot 16. ALSO EXCEPTING THEREFROM the 1~estery 191.00 feet of said Lot 18. WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on April 12, 1976, at 1:3~ P•m•~ notice of said pubtic hearir.g having been duly given as required by law and in accordance ~+rith the provisions of the Anaheim Nunicipal Code, Chapter 1f3.03. to hear and consider evidence for and against said proposed reclassification and to investigate and make findings.and recommendations in connection therewith; and NHEREAS, said Commission, after due inspectlon,,investigation and study made by itself and in its behalf~ and after due consideratlon of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the petitioner proposes a reclassification of the above-described property from the RS-A-43.000 ,(RESIDENTIAL/AGRICULTURAL) ZONE to the RS-5000 (RESIDENTIAL, SINGLE-FAMILY) ZOtJE. 2. That the Anaheim General Plan. as amended, designates the nortlierly portion of subJect property for low-medium density stngle-family residential uses and the southerly portion adJacent to RS-7200 homes for low density single-family residential uses. 3, That. on the basis of concerns voiced by adJacent property owners to the south. the petitioner stipulaYed that consideration would be given to locating ~ minimal number of two-story homes on the lots ad)acent to the one-story homes in thc existing tracts in order to minimize the visual impact and preserve the privacy of those existing homes. 4, 7hat the .petitioner stipulated to conformance wlth Council Policy No. 542~ pertatning to sound attenuation in residentlal proJects adJacent to railroads. 5. That the proposed reclassification of sublect property is necessra~Y and/or desirable for the orderly and proper development of the community. 6. That the proposed reclassiftcation of subJect property does properly relate to the zones and their permitted uses locally established in close proximlty to subJect property and to the zones and their permitted uses generally established chroughout the community. 7, That the proposed reclassiftcation of subJect property requires the dedication and improvement of abutting streets in accordance wlth the Clrculatlon Element of the General Plan. due to the anticipated increase in traffic whlch will be generated by tl'ie intensification of land use. 8. That one (1) person appeared at sald public hearing ln o~position; and no correspondence was received in opposltion to subJect petttion. RE50S.UTION N0. PC76-66 ~ ~ ENVIRONMEtITAL IMPACT REPORT fINDING: That the Anaheim City ?ianning Commissiun does herehy recormnend tu the CTty Council that the subJect project be exempt fror~ the requiremnnt to prrpare an environmental impact report, pursuant to the provisions of the Californta Environmental Quality Act. NOW, Tf~EREFORE, B[ IT RESOLVED that the Anaheim City Flanning Commission does hereby recommend to the City Louncil of tF~e City of Anaheim that subJect Petiti~n for Reclassification be approved and, by so dning, that Title 1P-Zoning of the Anaheim Municipal Code be amended to exclude the ahove-described property from the RS-A-t~3,00 (RESIDENTIAL/AGRICII~TURAL) ZOHE and to incorporate said described property into the RS-y0~!1 (RES!DE~~TIAL~ SINGLE-FAMILY) ZO~JE upon the following conditions which are hereby faund to be a necessary prerequisite to the proposed use of the Citizens of the City of Anaheim: 1. That fire hydranCs shali be installed and charged as requirr.d and determined to be necessary by the Chief ~f the Fire Department prior to commencement of structural framing. 2, That a final tract map of subJect property shall be submitted to and approved hy the City Council and then be recorded in the Office of the Orange County Recorder. 'i, That, in order to minimizP the visual imaact and preserve the privacy of the existing homes to the south of subJec'c property, ~ minimal number of two-story homes will be located adJacent to those Pxisting one-story homes, as stipul~ted to by the petitioner. ti. That developm~nt of suhJect property will confnrm to Council Policy No. 5k2, pertaining io sound attenuation adi~cent to railro~~ls~ and that plans to red~ce the noise level generated hy the riilr~ad shall he submitted to the City Council for review and approval prior to intrnduction of an ~rdinance rezoning subJect property, as stipulated to by the petitioner. 5, Prior to the introductinn of an ordinance rezorting suhJect prooerty, Condition flo. 2, abovP-mentioned, shall he comnleted.
