PC76-4 ADGPTED IN CONNECTIO~I WITH CONDITIONAL USE PER!11T N0. 159~ SAID CO~IDITIOH PERTAiNING TO IPJSTALLATIOPI OF STREET LIGHTING fACILITIES. WHEREAS, an January 5, 1976, 1[he Anaheim City Planning Commisslon granted Conditionai Use Fermit Plo. 1591 on subJect pro~erty under Resolution No. PC76-4, to permit outdoor recreational vehicle storage in the ML (Industri~l. Limited) Zone with waivers of permitted uses, minimum front setback and mininum land5caped setback subject to conditions, said property consisting of appr~ximateiy S•~ acre~~ tocated aC the northeast corner of Pacifico Avenue and Lewis Street and further described as 917 Fast Pacifico Avenue; and WHEREAS, Condition No. 3 of said Resolution tio. PC76-4 states "That street lighting facilittee along Pacifico Avenue and Lewts Street shall be installed as required by the Director of Public Utilities and in accordance with standard plans and specifications on file in the Office of the Director of Puhlic Utilities, and that a bond in an amount an~:i form satisfactory to the City of Anaheim shall he posted with the City to guarantee the installation of the ahove-mentioned requirements."; and WHEREAS, foilowing City Council review of Conditional Use Permit No. 15Q1 twenty-two days (22) days after Planning Commission granted said petition, t~ie petitioner requested deletion nf Condition No, 3 of Resolution No, PC76-4 on the basis that the approved use was tenporary in nature, for a period of three (3) years subject to possible review and approval of time extenstons, and further requested that the condition be deleted until subject property is developed to its ultimate capacity; and WHEREAS, the City Planning Commission did hold a puhlic hearing at the City Hall in the City of Anaheim on April 12, 1Q7G, at 1:3~ P•m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, to hear and consider evidence for and against said proposal to amend the conditions of approval of Conditional Use Permit No. 1591, and to investigate and make findings ard recommendations in connection therewith; and WHEREAS, sai~ Commission, after due inspection, investigation and study made by itself and tn its hehalf, and after due consideration of all evidence and reports offered at said hearin9. DOES HEREBY FIND: 1. '(hat the petitioner i~dicated the approved use~ being a recreational vehicle storage yard, is temporary in nature and requested that Condition No. 3 be deleted until the subject property is developed to its ultimate capacity. 2. That a temporary waiver for the installation of street lighzing facilities along Paciftco Avenue and Lewis Street would be appropriate on the basis that the presr,nt use of the property is temporary in nature and for a time Iimitation similar to that of the approved conditional use. 3. That the Director of the Planning Department has determined that the proposed activity falls within the definition of Section 3.~1, Class 1; of the City of Anaheim fuidelines to the Requirements for an Environmental Impact Report and is, therefore, categorically exempt from the requirement ;o file an EIR. RESOLUTIO~~ t70. PC76-6'B ~ ~ tJOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commissi~n does hereby amend Resolution Plo. PG76-4 granting Conditional Use Permit No. 1591, amending Condition No. 3 to read as follows: "3, That a temporary ~•laiver for instatlation of street lighting facilitiA; along Pacifico Avenue and Lewis Street is granted in con.junction with the duration of the recreational vehicle storage yard use of the property or for a time limitation of ttiree (3) Years. whichever occurs first, subject to review and consideration for an extension ~f timP hy the Planning Commission upon written rec,uest from the petitioner."
