PC 76-82~ ~ RESOLUTION N0. PC7fi-87. A RESOLUTION Of THE ANAHEIH CITY FLAPlNING COMMISSION T{iAT PETITION FOR VARIANCE N0. 1521 (READVERTISED) BE GRANTED. WHEREAS, the Anaheim City Planning Commission did receive a vPrifiPd Petition for Variance from VICKI BECKHAM, 1926 W. Ash Street, Fullerton, Califnrni:~ 92633 (Owner) of certain real property situated in the City of Anaheim, County of Orange~ State of California described as: Lots 4 and 5 of the South Street Tract, as sh~wn on a map recorderl in R~nk ?, Page 89 of Miscellaneous Maps, Records of Orange County, California. WHEREAS, the City Planning Commission did hold a public hearin~ at the City Hall in the City of Anaheim on April 2fi, 197Fi, at 1:3~ P•m., notice ~f saicl nublic hearin9 havin9 been duly 9iven as requlred hy law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 1~.03, to hear an~f considPr evidence for and against said proposed variance and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due lnspecti~n, lnvestigation and sturiy marle by itself and in its behatf, and after due consideration of all evidence and rr.ports offered at said hearing, does find and determine the followi~g facts: 1. That the petitioner proposes the foll~wing waiver from the Anaheim Municipal Code, to establish an auto sales lot in the RM-12Q0 (RESIDEIIT111L, MIII.TIPLF- fAMILY) ZONE: SECTION 18,34.Q2~ - Permitted uses. (auto sa?es lots and temporary o~1ce trailers not permitted) 2. That th~ above-mentionr.d waiver is hereby granted, granting the autn sales lot use on the basis that the subJect property has been utilized as an auto sales lot for approximately 12 years, the proposed use is compatible with surr~un~iing land uses, and no complaints are on record against satd use; and furthermore arantin9 the temporary use of an office trailer for a period of one (1) year, suhject to review and consideration for an extension of tlme, said time limitation being hasPd upon petitioner's indicating that subJect trailer was to be utilized for an o`fice temporarily until and if it became feasible to construct a permanent buildina. 3. That tFere are exceptional or extranrdinary circumstances or cnnditions applicable Co the property involved or to the intended use of the property th~t do not apply generally to the property or class of usP in the same v!cinity and ~nne. 4. 7hat the requested variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question. 5. That th~e requested varlance wil) not be materially detrimental to :he public welfare or injurious to the property or improvements in such vicinity anri zone in which the property is located. 6. That no one indicated their presence at said puhlic hearincl in opposition; and no correspondence was received in opp~sition to subject petiti~n. ENVIRO~~NENTAL IMPACT REPORT FINDItJG: That the Director of the Planning Department has determined ttia[ the proposed acti~rity falts within the definition of Section 3.~~, Class 1, of the: City of Anaheim Guidelines to the Requtrements for an Environment~l Impact Report ein~l is, therefore, categorically exempt fr~m the requirement to file an fIR. t~OW, THEREFORE~ BE IT RESOLVED that the Anaheim City Plannin9 Comnissi~n does hereby grant subject Petition for Variance, upon the following c~nditinns which are hereby found to be a necessary prerequisite to the proposed use of the suhJect property in order to preserve the safety and general welfare of the Citi~ens nf the City uf Anaheim: RESOLUTIOH ~10. PC7F-n2 ~ ~ 1. That the owner(s) of subJect property shali pay to the City of Anahetm the sum of S2.00 per front foot along Anahelm eoulevard fnr street lightinq purp~ses. 2. That the ow~er(s) of subject propeFty shall pay to the City of Anaheim the ~iim of 60 cents per front foot along !~naheim 43oulevard fc~r trer ~lanting purposes. 3. That trash storage areas shall be provided in accordance with appr~vr.d plans on file with the Office of the Direr.tor of Public Works. 4. That subJect property shall 6+; developed substantially in accordance with pians and specificaCions on file with the City of Anaheim marked Exhihit tJcs. 1, 2~ 3, and 4. 5. That Condition tlos. 1 and 2, above-mentioned, shall be compiird with prior to the commencernent of the activity authorized under this resolution or prior to the time that the buildin9 permit is issued~ or within a period of one (1) year from the date hereoF, whichever occurs first, or such further time as ehe Planning Commission and/or City Council may grant. 6. That Condition Nos. 3 and 4, above-mentioned, shali be complied with prior to final building and zoning inspections. 7. Thzt the use of the trailer fqr a mobite sales office shall be granted for a period of one (1) year, subject to review and consideration for an extFnsi~n of time by the Planning Commission, upon written request from the petitioner.
