PC 76-93~' ~ ~ ~ RESO!UTION NQ. PC76-93 A RESOLUTIOM OF THE A~7AHEIM CITY PLAN~7ING COMMISSI~N THAT PETITION FOR VARIANCE N0. 2000 RE GRAIVTED. WHEREAS, the Anaheim City Planning Cummission did receive a verified Petition for Variance from HAR~Y A. AMANN, 2$23 Alden Place, Anaheim, California 92306 (Owner) of certain real property situated in the City of Anaheim, County of Orange, State of California described as: Lot No. 62 of Tract Plo. 40~6, in the Ctty of Anaheim, as shown 3n Book 147, Pages 12-13, t1iscellaneous Maps, Records of Orange County. WHEREAS, the City Planning Commission did hold a public hearing at the Lity Hall in the City of Anaheim on May 10, 1~7~, at 1:3~ P•m., notice of said public hearing having been duty given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 13.~3, to hear and cnnsider evidence for and against said proposed variance and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study ma~e by itself and in its behalf, and after due consideratton of all evidence and reports nffered at said hearing. does find and determine the following facts: 1, That the petitioner proposes the ~ol!o~~ring waiver from the Anaheim 1•lunicipal Code, to retain an existing garage conversio~: SECTION 18.26.066.011 - Ninimum number of enciosed arkina spaces. 2 required; n~ne existing 2, 7hat the above-mentioned waiver is Fi~:reby granted for a period of one (1) year, subject to review and consideration for ex2ensions of time to determine whether any parking problems occur because only two (2) on-site spaces are available and four (4) are required; and, furthermore, to determine whether two (2) additional on-site spaces should be required, particularly in the event subJect property is sold, as stipulated to by the petitioner. 3. That the petitioner stipulated to providing a strip of blacktop or cement approximately two (2) feet wide alongside the existing driveway to accommodate the parking of two (2) automobiles in said driveway, if additional on-site parking becomes necessary. 4. That tnere are exceptional or extraordinary circumstances o~ conditions applicable to the property involved nr to the intended use, as granted, of the property that do not apply generally te'the property or class of use in the same vicinity and zone. 5, That the requested variance, as granted, is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone. and denied to the property in question. 6. That the requested variance, as granted, w{ii not be materially detrimental to the public ~aelfare or i~Jurious to the property or improvements in such vicinity and zone in which the property is located. 7, That three (3) Persons appeared at said public hearing in favor of the proposal; and that no one indicated their presence in opposition to the proposal and no correspondence was received in opposition. ENVIRONMENTAL IMPACT REPQRT F1NDi~~G: That the Director of the Planning Department has determined that the proposed activity falls within the definition of Section 3.~1, Class 1, of the Ciiy of Anahelm Guidelines to the Requirements for an Environmental Impact Report and is, therefore, categorically exempt from the requirement to file an EIR. NOW, THEREFORE, BE IT RESOLVED that the Anaheim CCty Planning Commission does herPby grant subject Petition for Variance, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subJect RESOLUTIOt~ NQ. PC7~-93 ~ ~ ~, property in order to preserve the safety and general welfare of the Citizens ~f the City of Anaheim: 1. That subJect property shall be developed substantially in accordance with plans and specifications on file with the City of Anahelm marked ExhibTt ~~os. 1 and 2; provided, however, that if additional on-site parking becomes necessa~~~, a strip of blacktop or cement approximately two (2) feet wioe may be required alongside the existing driveway to accommodate the parking of two (2) automobiles in said driveway, as stipulated to by the petitioner, 2. That plans shall be submitted to the Building Division showing compliance with the minimum standards of the City of Anaheim. including the Uniform Duilding, Plumbing, Electrlcal, Housing, Mechanicai and Flre Codes as adopted by the City of Anaheim. The appropriate permits shall be obtatned for any necessary work. 3. That Con~ition Nos. 1 and 2, above-mentToned, shall be complied with a~ithin a period of three (3) months from date hereof, or such further time as the Planning Commission may grant. 4. That a time limitation of one (1) year shall be granted for this variance to determine whether any parking problems occur because of the minimal available on-site parking spaces and, that upon written request by the petitioner, an additional period of time may be granted by the Ptanning Commission; provided, however, that four (4) on-site spaces may be required in the event subJect property is sold, as stipulated to by the petitioner.
