PC77 °104 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR CONDITIONAL USE PERMIT NO. 1707 BE GRANTED WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Conditional Use Permit from LEWIS R. AND JUDITH SCHMID, 1631: Langley Avenue, Irvine, California 92714 (Owners) and S.C.G. PROPERTIES, 1631 Langley Avenue, Irvine, California 92714 (Agent) of certain real property situated in the City of Anaheim, County of Orange, State of California, described as: Beginning at the centerline intersection of Katella Avenue and Douglass Street in the City of Anaheim; thence North 89 32' 10" West 65.25 feet along the centerline of Katella Avenue; thence South 00 27' 50" West 60.00 feet to the TRUE POINT OF BEGINNING; said true point of beginning is also a point in the existing southerly line of Katella Avenue; thence North 89° 32' 10" West 184.85 feet along said southerly line; thence South 26 59' 36" West 44.73 feet; thence South 00 31' 49" West 156.20 feet; thence South 19 08' 41" West 190.43 feet; thence South 84 09' 31" East 256.88 feet to a point in the existing westerly line of Douglass Street; thence North 05 50' 29" East 375.00 feet along said westerly line to the beginning of a tangent curve concave southwesterly and having a radius of 25.00 feet; thence northwesterly 41.62 feet along said curve through a central angle of 95 22' 39" to the TRUE POINT OF BEGINNING; a radial line through said point bears North 00° 27' 50" East. The area of the above - described parcel equals 2.041 acres; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on May 9, 1977, at 1 :30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 10.03, to hear and consider evidence for and against said proposed conditional use and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18.61.050.360, to wit: permit a private recreational facility in the ML (INDUSTRIAL, LIMITED) ZONE. 2. That the petitioner stipulated to constructing a solid landscaped median in Katella Avenue in front of the subject property to prohibit left turns. 3. That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 4. That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. That the granting of the Conditional Use Permit under the conditions imposed, if any, will not be detrimental to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 6. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to the subject petition. ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning Commission has reviewed the subject proposal consisting of a private recreational facility on approximately 2.0 acres of land located at the southwest corner of Katella Avenue and Douglass Street, and does hereby recommend to the City Council of the City of Anaheim that a Negative Declaration from the requirement to prepare an environmental impact report be approved for the subject property on the basis that there would be no significant individual or cumulative adverse environmental impact due to the approval of this Negative Declaration since the Anaheim General Plan designates the subject property for general industrial land uses commensurate with the proposal; that no sensitive environmental elements are involved in the proposal, and the Initial Study submitted by the applicant indicates no significant individual or cumulative adverse environmental impacts; and that the Negative Declaration substantiating the foregoing findings is on file in the office of the Planning Department at City Hall. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That sidewalks shall be installed along Douglass Street as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. 2. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Director of Public Works. 3. That fire hydrants shall be installed and charged, as required and determined to be necessary by the Chief of the Fire Department, prior to commencement of structural framing. 4. That subject property shall be served by underground utilities. 5. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 6. In the event that subject property is to be divided for the purpose of sale, lease or financing, a parcel map, to record the approved division of subject property, shall be submitted to and approved by the City of Anaheim and then be recorded in the Office of the Orange County Recorder. 7. That appropriate water assessment fees, as determined by the Director of Public Utilities, shall be paid to the City of Anaheim prior to the issuance of a building permit. -2- RESOLUTION N0. That either (a) the proposed driveway on Katella Avenue shall be deleted or (b) a solid median shall be constructed in Katella Avenue in front of the subject property to prohibit left turns, as approved by the Traffic Engineer. 9. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 4; and that a solid landscaped median shall be constructed in Katella Avenue in front of the subject property, as stipulated to by the petitioner. 10. That Condition No. 6, above mentioned, shall be complied with prior to the commencement of the activity authorized under this resolution, or prior to the time that the building permit is issued, or within a period of one year from date hereof, whichever occurs first, or such further time as the Planning Commission and /or City Council may grant. 11. That Condition Nos. 1, 2, 4, 5, 8 and 9, above mentioned, shall be complied with prior to final building and zoning inspections. 1977.
