KORUER, 1110 South Robertson Boulevard, Los Angcles, California 90035, agent, of certain real property situated in the City of Anaf~eim, County of Orange, State of California, described as: Lot 51 of Tract IJo, y674, as pcr map recorded in Book 307, Page 22, 7_; and 2~t of Misceilaneous Maps, records of said County; and WHEREAS, the City Planniny Coramission did hold a public hearing at the City Hall in tfie City of Anaheira on June 10, 1977, at 1:30 p.m., no[ice of said public heariny havin~ been duly yiven as required by law and in accordance with the provisions of the A~aheim fiunicipal Code, Chapter 1c.03, to hear and consider evidence for and against said proposed condi[ional use and to investigate and make findings and recommendations in connection therewith; and WiiEREAS~ said Conu~iission, after due inspection, i~ves[i9a[ion and study made by itself and in its behalf, and after due considera[ion of all evidence and reports offered at said heariny, does find and determinc the following fac[s: 1. Tha[ the proposed use is properly one for which a conditional use permit is authorized by Anahei~a Municipal Code Section 13,24.050.030 t.o canstruct a church. 2. That ttic proposed u,e is hercby granted subject to szipulations by the petitioner [o: a. Install a six (G) foot high blocl: wall along the north property line to provide visual screening between the proposal and the adjacent residences; b. Madify the proposed cnurch towr_r to comply wi[h maximum building height requirement of thirty (30) feet in the RS-HS-10*OOQ(SC) Zone.; c. Modify driveway accesses to a ninety ~90) deyree alignment from the adjacent public streets to maximize visibility for entering and exiting vehicles, in accordance with the Traffic Engineer's recomnendation; d. Instail parl:iny area liglitiny which will b~ shielded down and away from adjacent residential areas and will be a maximum of twelve (12) feet in height, and [hat all parking arca lighLiny will be turned off, except sccurity llghts, by 10:00 p.m, on vieekdays and no later than 12:00 midnight on Saturdays and Sundays; e. Install spced bumps in all parking areas to discourage speeding; and f. To par[icipate in the cost of instailing traffic signals a[ the intersection of Nohl Rancli Road and Royal Oak Road, in accordance with the Traffic Engineer's recommendation and Council Policy ~lo. 214 "7~afflc Signal Assessments". pc77-t35 3. EtJVIRO!„1E1lT~L ItiPACT FINDING: That [he Anahein City Planni~g Commission has reviewed the subject project consisting of a cl~urch facility on approximately 3.0 acres of land lotated at the nor[hwest corner of i~ohl Ranch Road and Royal Oak Road, and does here6y reconunen~ to the City Council of the City of Anaheim tha[ a ilegative Declaration from the reyuirement [o prepare an environmen[al impac[ report be approved for the subject propcrty on che basis that there would be no significant individual or cumulative adverse environment~l impact due tc the approval of this tlegative Declaration since the llnaheim General Plan designates t!ie subjec[ property for low-density residcntial land uses; that the propcrty has been owned by the petitioner for a number of years and has been planne~j for a church, and the combined effect of tl~is church and other cfiurches in the area will not be siynificant; that no sensitive environmental elemen[s are involved in this proposal, and thc I~itial Study submitted by the applican[ indicates no siqnificant individual or cumulative adverse environmental impacts; and that [he Negative Declaration substantia[ing the f4regoing findings is on file in [he officc of the City of Anahcim Planniny Departmenr. tJOW, TIIEREFORE, BE IT RESOLVED tha[ the Anaheim City Planning Commission does hereby grant subjec.C PeYition for Londitional Use Permit, upon [he following conditions wliich are her~by founci to be a necessary prerequisite to [he proposed use of the subject property in ordcr to pres~erve tlie safety anJ 9eneral welfare of the Citizens of the City of Anaheim: 1. That fire hydrants shall bc ins[alled and charged as required and determined to be necessary by [he Chief of tfie Fire Department prior to commencement of structural framino. 2, That the appropria[e wat~r assessmen[ fees as ~e[ermined by thc Director of Public Utilities shall be paid to [he Clty of Anaheim prior to the issuance of a building permit. 3, That subject proper[y stiall be developed substantially in accordance with plans and specifications on file wich the Ctty of Anaheim marked Exhibit Nos. 1, 2 and 3, provided, however, tl~at a six (6) foot high block wall shall be constructed on the north property line; that the proposed church ta,rer shall be redesigned to comply with the rnaximum RS-NS-10,000(SC) height requirement of thirty (3'~) feet; that all driveway approaches shall be redesigned at a ninety (90) degree alignment from the publlc s[reets in accordance with [he Traffic Engineer's recommendation; and that "speed bumps" will be installed in all parking areas. _2_ PC77-135 4. That Condition Nos. 3 and 4, above mentioned, shall be complied with prior to final building and zoning inspectians. 5. That all parking area iiyh[Eng sliall be shiclded down and away from residential areas and shall bP a maximum fieigtit of 12 feet, and that all lighting shall be turned nff, except security lights, by 10:00 p.m. on weekdays and no later than 12:00 midnight on Saturdays and Sundays. 6. That the petitioner sha!1 participate in the cost of installiny a trafftc signal at the intersection of Nohl Ranch Road and Royal Oak Road, in accordance witfi Council Policy t~o. 214 "7raffic Si9na1 Assessments".
