AND VIOLET P. NALL, AUBREY F. R. AFID CATNERINE HOLMES, 2740 4Jest Lincoln Avenue, Anaheim, Ca!ifornia 92a01, owners, and OCTOBER ENTERPRISES, 1;Oj Avocado Avenue, Suite 195, Plevrport Beach, California 92660, agent, of certain real proper[y situated in the City of Anaheim, County of Orange, State of California, described as: The East 1~0.0~ feet of the Wes` 315.C0 feet of the Northeast quarter of the Northwest quarter of the I~ortheast quarter of Section 13, Township !i South, Ran9e 11 ~Jest, in the Rancho Los Coyotes, as per rnap recorded in Book 51, nage 11 of Miscellaneous Maps, in the office of [he Loun[y Recorder of said County. EXCEPT the hlorth 66 fcet thereof; and WNEREAS, the City Planning Commission did sc;iedule a public hearing at the City Hall in tlie City of Anaheim on July lo, 1977, at 1:30 p.m., notice of said public heari~g having 6een duly given as required by lah and in acccrdance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use and to investigate and make findings and recommendations in connection therewitfi; said public hearing having been continued to the Planning Comrnission meeting of August 1, 1977; and WNEREAS, said Commission, after ~ue inspection, investigation and study made by itself anJ in its behalf, and after due consideration of all evidence and reports offered at safd hearing, does find and determine the following facts: 1. That [he above referenced v~aiver (a) is granted an the basis that the previously established building se*_back on subject property is 3Q feet and all new additions will follow said existiny setback line; that waiver (b) is ~ranted, in part, to permit a chainlink fence along the south property line only, since the adjacent property is developed with a plant nursery and site screening in the form of a block wali is unnecessary; and subject to the petitioner's stipulation to provide a G-foot high block wall along the east property line, said wall height to be measured frum the highest porCion of subject property to adeyuately screan the proposal from tfi e existing residences; and subject to the property being developed substantially in ac:cordance with plans and specifications on file with the City oT Anaheim marked Revision Nu. 1 of Exhibit t~o. 1 and Exhibit Nos. 2 through 5, the Pc-163 3. That the size and shape of the site proposed for the use is adequate to a11aN the full development of the proposed use in a manner not detrimental to the perticular area nor to the peace, health, safety, and general o-~elfare of the Citizens of the City of Anaheim. 5. That the grantiny of the Conditional Use Permit undcr the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the CiLizens of the City of Anaheim. G, That three (3) persons indicated their presence at said public hearing in opposition; that no corres~ondence was received in opposition to the subject petition; and that the petitioner submitted a petition wi[h twelve (12) persons endorsing [he project. E~lViRONMENTAL IMPACT FINDIt~G: That the Anaheim City Planning Commission has reviewed the subject project consisting of a recreational vehicle parF: in conjunction with a motel with waivers of minimum buildiny setback and required block wall, on approximately 1.5 acres haviny a fronta9c of approximately 190 feet on the south side of Lincoln Avenue, being located approximately 79Q feet east of the centerline of Dale Avenue, and further described as ?74U West Lincoln Avenue, and does hereby approve the ~~eyative Declaration from the requirement to prepare an environmental impact report on the basis that [harc would be no significant individual or cun;ulatlve adverse environmental impact due to the approval of this Negative Declaration since tlie Anaf~eim General Plan designates [he subject property for general commercial land uses cormensura[r_ with the proposal; that no sensitive environmental impacts are involved in the proposal; that the Initial Study submitted by the petitioner indicates no significant individual or cumulative adverse environmental impacts; anci tf~at the Negative Declaration substa~[iating the foregoing findings is on filc in the City of Anaheim Planning Department. NOW, TfiEREFOP,E, BE IT RESULVED tha[ the Anaheim City Planning Lommission dor.:s hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby fou~:d [o be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare oT the Cit~izens of Che City of Anaheim: i, That the owner(s) of subject propcrty shall pay to thc City of Anahe(m the sun of sixty cents (60C) per front foot along Lincoln Avenue for tree pianting purposes. 2, That the owner(s) of subject property shall pay to the Ci[y of Anaheim the sum of two dollars ($2.0~) per front foot along Lincclri Avenue for street lighting purposes. 3, That drainaoe of subject property shall be disposed of in a manner satisfactory to the City Enyineer. 4. That the proposed development shall be in accorclance with the requirements of Title 25, California Adrninistrative Code, and that the plwnbing shall be provided in order that the travel trailer park will accommodate all trailers and not be restr'lcted to "California approved trailers" only. _2_ PC77-163 ~ 5. That trash storage areas shall be provided in accordance a~ith approved plans on file with tfie Office of the Director of Public Works. 6, That fire hydrants shall be installed and charged, as required and determined Lo be necessary by the Chief of the fire Department, prior to commencement of structural framing. 7. That appropriate watcr assessment fees, as determined by the Director of Public Utilitles, shall be paid to the City of Anaheim prior to the issuance of a building permlt. 8. That subject property shall be developed substantially in accordance with plans and speciiications on file wiSli the City of Anaheim marlced Revision tlo. 1 of Exhibii No. 1 and Exhibit Nos. 2 through 5, 9. That Condition ~~os. 1 and 2, above mentioned, shall be complied with prior to the commencement of the activity authorized under this resolution, or prior to the time that the buildiny permit is issued, or within a period of one year from date hereof, whichever occurs first, or such fur[her time as the Ptanning Commission may grant. 10, That Condition Nos. 3, ~i, 5 and tl, above mentioned, shall be complied with prior to final builcling and zoniny inspections.
