THl1T PETiT16~i ~^R COPIDITIONAL USE PERMIT N0. 1750 BE DENI[D WHEREAS, the Anaheim City Planniny Commission 1id receive a verified Petitien for Conditional Use Permit from RICFIARD JAY A~~D TO~~IA LYNi~ K:~UFMAM, 803 Cinda Street, Anaheim, California 92806, arners, and FA111LY GROUP N01•1E5 FOUNDATION, 1~20 East Katella Avenue, Suite U, Oranye, California 926G7, agent, of certain real property situated in thc CiCy of Anaheim, County of Oranye, State of California, described as: Lot 34 of Trac[ 41G$ as per map recorded in book 150, pages 14 and 15 of 1liscellaneous Haps, records of said county and sta[e; and WHEREAS, the City Planning Commission did hold a public liearing at the City Hall in [he City of Anaheim on September 12, 1;77, at 1:30 p.m., notice of said public hearing having been duly yiven as required by law and in accordance with the orovisions of the Anaheim Hwiicipal Code, Chapter 1~'.03, [o hcar and consider evidence for and against said proaosed conditional use and t~ inves[iyate and make findings and recommendatians in connection therewith; and WNEREAS, said Commission, aftcr duc inspection, investigation and study made by itself anJ in iis behalf, and after due consideration of all evidence and reports offered at said hearing, does find and Je[ermine the following facts: 1. That tlie proposed use is properly one for which a condit(onal use perm(t is authorized by Anatieirn Mur.icipal Code Section 1~.2G.05''i.010, to wit: to permit a children's group home. 2. That the proposed conditional use permit is hereby denied on the basis that the yroup liome has becn operating a~ithou[ the approval of a conditional use permit and problems wi[h the neiyhbors have occurred; and thai the use, as proposed and existiny, fias had a deletcriuus impact on the surrounding single-fanily uses. 3. That the proposed use will adverscly affect the adjotning land uses and the growth and developmenc of the area in which it is proposed to be located. 4. That the size and shape of the site proposed for [he use is not adequate ta allow the full deveiopment of the proposed use in a manner not detrlmenial [o the particular area nor to the peace, health, safety, and general welf~re of the Citizens of Che City oP Anaheim. 5, That the grantiny of [he Co~ditional Use Permit will be detrimc;ntal to the peace, health, safety and yeneral ti•relfare of [he Ci[izcns of [he Lity of Anaheim. G. That approximately 31 persons indicated their presence at said publlc he~ring in opposition and one let[er and a petition containing 50 signatures from 42 addresses were received in oppositi~n. EI~VIROtIMENTAL IMPACT FII~DING: That the Director of [he Planning Department fias determined that the c~roposed activity falls wlthin the definition of Section 3.01, Class 1, of tf~e CEty of Anaheim Guideiines to tne Requirements for an Environmentai fmpact Report and 'ss, therefore, categorically exempt from the requirement to file an EIP..
