permit is ~uthorized by Anaheim Municipal Code Section 1g,~~1.05n,~]0 Lo wi[: to

2. That the propo~ed use is hereby granted subjsct to review by the
Planning Commission at the end of a one-year period [o determinr_ whether the use has
been detrimen[al to *_he area.
3. The proposed waiver is hereby denied on the basis that the petitioner
stipulated to providino off-site parking on adjacent pronerty in accordance with Code
requirements including parkinq aoreement approved by the City Attorney, and to
improving said off-site parking area in conformance with all Code requirements, and
to enclosing all outdeor storage areas ~•rith wood-slatted chainlink fencing.
4. That the proposed use, as 9ranted, will not adversely affect the
adjoining land uses and the groo-+[h and devetopment of the area in which it is
proposed to be loca[ed.
5. That the size and shape of ihe site proposed for [he use, as granted,
is adeouate to allow the full develoomen[ of the proposed use in a manner not
detrimental to the particular area nor to the peace, health, safety, and general
welfare of the Citizens of the City of Anaheim.
6, That [he Conditlonal Use Permit, ~s granted, and under the conditions
imposed, will not be detrimental to the peace, health, safety ana neneral welfare of
the Citi~ens of the City of Anaheim,
7. That no one indicated their presence at said public hearing in
opposition; and that no correspondence aras received in oppos?tion to the subject
petition.
ENVIP,ONNEI~TAL i!dPACT rINDiPiG: That the C`rector of the Plannin9 Deoartment
has determined that the proposed activity falls ~ithin the definition of Section
3.~1, Class 1, oT the City of ~.nahe(m Guidelines to thP requirements for an
Environmental Impact Report and is, therefore, categorically exenpt from the
requirenent to file an EIP,.
tJOW, THEREFORE, BE IT RE50L"EJ that the Anahein Ci[y Planning Commission
does hereby grant, in part, subject Pe[ition for Conditional Use Permit, upon the
following conditions which are herehy found to be a necessary prerequisite to the
proposed use of the suhject property in order ta presr_rve the safety and general
welfare of the f.itizens of the City of Anaheim:
i. That [he appropriate permit he obtained for the proposed spray paint
booth from [he City of Anaheim Fire Departmrnt prior to the commenr.ement of activity.
1. That subject property shal! be developed substantially in accordance
with pla~s and specifications on file riith the City of Anaheim marked Exhibit No. 1.
