PC77 -283 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR CONDITIONAL USE PERMIT NO. 173 BE GRANTEE WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Conditional Use Permit from SUNSHINE WAY, 2 "nr S. Main, Unit K, Santa Ana, California 02701, owner, and FALLOH CUSTOM VANS, 124.1 Sunshine Way, Anaheim, California 92306, agent, of certain real property situated in the City of Anaheim, County of Orange, State of California, described as: Parcel No. 4 as shown on a Map filed in Book 04, nage 48 of Parcel Maps in the Office of the County Recorder of Orange County, California. WHEREAS, the City Planning Commission did hold a puhlic hearing at the City Hall in the City of Anaheim on December 10, 1977, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 13.03, to hear and consider evidence for and against said proposed conditional use and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 13.41.051.070 to wit: to permit a van conversion facility with painting and body repair. 2. That the proposed use is hereby granted subject to petitioner's stipulation that all repair work will be done wholly inside the building and that the hours of operation will he from 8:00 a.m. to 5 :30 p.m. during weekdays, and 9:01 a.m. to 2:00 p.m. on Saturday, and that not more than ten (i0) vehicles being serviced will be stored outdoors and that said vehicles will he stored in accordance with City Code requirements. 3. That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to he located. 4. That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 5. That the granting of the Conditional Use Permit under the conditions imposed, if any, will not be detrimental to the peace, health, safety and general welfare of the Citizens of the City of Anaheim. 6. That no one indicated their presence at said public hearing in opposition) and that no correspondence was received in opposition to the subject petition. ENVIRONMENTAL IMPACT F I N D I N G : The Director of the P l a n n i n g Department has determined that the proposed activity falls within the definition of Section 3.01, Class 1, of the City of Anaheim Guidelines to the Requirements for an Environmental Impact Report and is, therefore, categorically exempt from the requirement to file an EIR. PC77 -283 NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That a permit for the spray paint booth shall be obtained from the City of Anaheim Fire Department. 2. That subject property shall he developed substantially in accordance with the plans and specifications on file with the City of Anaheim marked Exhibit Nox. 1 through 3. 3. That Condition No. 1, above- mentioned, shall he complied with prior to the commencement of the activity authorized under this resolution, or prior to the time that the building permit is issued, or within a period of one year from date hereof whichever occurs first, or such further time as the Planning Commission may grant. 4. That Condition .1o. 2, above - mentioned, shall he complied with prior to final building and zoning inspections. 5. That all repair work will be done wholly inside the building. 6. That outdoor storage for not more than ten (10) currently being serviced be provided in accordance with City Code requirements.
