PC 77-42RESOLUTION NO PC77 -42 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR CONDITIONAL USE PERMIT NO. 1686 BE GRANTED. WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Conditional Use Permit from PHOENIX CLUB, INC., c/o MR. HEINZ KAHL, 1566 Douglass Rd., Anaheim, CA 92806 (Owner), and MR. HEINZ KAHL, 12132 Salerno, Garden Grove, CA 92640, (Agent) of certain real property situated in the City of Anaheim, County of Orange, State of California described as: PARCEL 1: That portion of Lot 4 of the Travis Tract, in the City of Anahe &m as shown on a map thereof recorded in book 5, page 120, Miscellaneous Records of Los Angeles County, California, described as follows: Beginning at a point in the center line of Douglass Street as conveyed to they. County of Orange by deed recorded October 7, 1926 in book 682, page 109, Deeds, records of said Orange County, said point being located 564.47 feet North 0 04' 30" West from the intersection of said center line with the center line of Katella Avenue running thence North 0 04' 30" West 179.00 feet along the center line of said Douglass Street; thence South 89 32' 10" East 350.00 feet;.thenoe south 0 04' 30 East 179.00 feet; thence North 89 32' 10" West 350.00 feet to the point of beginning. PARCEL 2: That portion of Lot 4 of the Travis Tract, in the City of Anaheim, as shown on a map thereof recorded in book 5, page 120, Miscellaneous Records of Los Angeles County, California, described as follows: Commencing at a point in the center line of Douglass Street as conveyed to the County of Orange by deed recorded October 7, 1926 in book 682, page 109, Dees, records of said Orange County, said point being located 564.47 feet North 0° 04' 30" West from the intersection of said center line with the center line of Katella Avenue and running thence North 0° 04' 30" West 179.00 feet along the center line of said Douglass Street; thence South 89° 32' 10" East 350.00 feet to the true point of beginning of the parcel of land herein described; continuing thence South 89 32' 10" East 194.96 feet to the East line on said Lot 4; thence South 0 14' 10" West along said East line, 179.00 feet; thence North 890 32' 10" West 193.99 feet to a point which bears South 0 04' 30" West from the true point of beginning; thence North 0° 04' 30" East 179.00 feet, more or less, to the true point of beginning. PC77 -42 PARCEL 1: The Easterly 263.80 feet of that portion of Lot 4 of the Travis Tract, Js Oo« on a Map recorded in book 5, page 120 of Miscellaneous Records of Los Angeles County, California, described as follows: Beginning at a point on the center line of Douglass Street, as described in a Deed to the County of Orange, recorded October 7, 1926 in book 682, page 109 of Deeds, distant North 0° 04' 30" West 743.47 feet from the intersection of saic center line with the center line of Katelia Avenue; thence South 89 32' 10" East 544.96 feet to the Easterly line of said Lot 4; thence North 0 14' 10" East along said Easterly line 337.35 feet to the Northeasterly corner of said Lot 4; thence North 89 30' 10" West along the Northerly line of said Lot 4; a distance of 546.80 feet to said center line of Douglass Street; thence South 0 04' 30" East along said centerline 337.69 feet to the point of beginning. WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on February 14, 1977, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in it's behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18.61.050.340, to wit: expand an existing private club. 2. That the proposal is hereby granted on the basis that the use is existing on the northerly portion of subject property and has not been detrimental to the surrounding area. 3. That the petitioner stipulated to the closure of the existing second driveway north of the south property line, said driveway to be replaced with standard curb, gutter, sidewalk, and landscaping. 4. That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 5. That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 6. That the granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 7. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received In opposition to the subject petition. ENVIRONMENTAL IMPACT REPORT FINDING: That the Anaheim City Planning Commission has reviewed the proposed project, consisting of the expansion of an existing private club on approximately 5.9 acres located on the east side of Douglass Road approximately 562 feet -2- RESOLUTION NO. PC77 -42 north of the centerline of Katella Avenue, and does hereby recommend to the City Council of the City of Anaheim that a Negative Declaration from the requirements to prepare an environmental impact report be approved for said project on the basis that there would be no significant individual or cumulative adverse environmental impacts on the subject property and surrounding area; that the cumulative effects of Negative Declarattons granted in the reporting area are not sufficient to 'require an Environmental impact Report; and that the Negative Declaration substantiating the foregoing findings is on file In the Office of the Planning Department at City Hall. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Cond'tional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That sidewalks shall be installed along Douglass Road as regu?rel 5v the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. 2. That fire hydrants shall be installed and charged, as required and determined to be necessary by the Chief of the Fire Department, prior to commencement of structural framing. 3. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Director of Public Works. 4. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 4; provided, however, that the existing second driveway north of the south property line shall be removed and replaced with standard curb, gutter, sidewalk, and landscape, as stipulated to by the petitioner. 5. That Condition Nos.1,3 and 4 ,above- mentioned, shall be complied with prior to final building and zoning inspections.
