provisions of the Anahei~n Hunicipal Lode, Chapier 18.03. to hear and consider
evidence for and against said proposed reclassiftcatlon and to Tnvestigate and make
findin9s and rncammendatio~s in connection thereNitA; an~i
LfFIEREAS, said Commission, after due inspection, investlgatiors and study made
by ltself and in its behalf~ and after due consideration of all evldertc~ and reports
offcred at sald hearing, does find and determine the follorring facts:
1. That the petitioner proposes reclassiflca[ton of subJect property from
the RS-7200 (Residential, Stngie-Family) Zone to the Cl (Commercial, Limited) Zone,
2. That al[hough the Anaheim General Plan designatcs subject property for
commerclal professional land uses, [he adjacent properties co the w._st are currently
zoned CL and developed wi[h commerctat uses, and subject proposat would be an
extension of satd zoning.

stipulatlon by Lhe pe[Itioner that thc property will be devcloped substantlally tn
acsordance Nith plans. as presented, to expand the exiscing comrne~cial uses (mattress

co~sisting of approximately 0.4 acre havl~g a frontage of approxlma;ely 7!j feei on
the south side of Vermont Street, having a maximun de~th af ii8 fe~~ and being
located approximately 162 feet east of the centerline of Harbor ~a~tevard; and does
hereby approve the Negatl~+e Declaratlon fran the requirement to prepare an
environmental impaGt report on the basis tha[ therc wouid be no sig~ificant
indiv'dual or cumulative adverse env!ronmental impact due te tne approval of this
Negative Declaration since [he Anaheim General Plan destgnates the sub)ect prope~ty
for commercial professtonal land uses commensurate ai[h the proposai; that no
sensltive environmental impacts are involved in the proposai; that the Initial Study
submitted by [he pecitioner indicates no significant indlvTdual or cumulative
adverse envtronmental impacts; and thac the Negative Dt~laratiort substantTating the

NOw~ THEREFORE, BE IT RESOLVE~ that th~ Anahcim Ctty P1annPng Commission
does hereby grani subjec[ Pecftfon for Reclassificatlon a~d. by so doing. that Ti[le
18-Zonl~g of the Anaheim Municipal Code be amendtd [o exclude the above-described
proper[y fran the RS-7200 (RESIDENTIAL, SIUGLE-Fl~riilY) ZONf and to incorparate safd
described propercy into the CL (COHMERCIAL, P,ROFESSIONAL) ZONE upon [he folloNing
conditlons wfiich are he by found to be a necessary prerequlsite to the proposed use
of subJect property (~ ordcr to preserve the safety and generai ~,~elfare of the
Cttizens of the Cicy of Anahelm:
1. Thai the owner(s) of subJect property shall pay to the Ctty of Anahe(m
the sun af three and one-half dollars ($3.50) per front foot aTong Yermont Avenue fo~
strect tlghting purposes.
2. That the a.ner(s) of subJect property shall pay to che City of Anaheim
thz sum of 95 cents per fro~t foot along Vermont Avenue for tree plantJng pu~poses.
3. That sidewalks shall be tnstalled alo~g VErmon[ Avenue as requlred by
the City Engineer an~ in accordance with standard plans and speclflcattons on file in
the oEfice of the Ctty Engineer.
4. 7hat subject property shall be served by underground utilitles.
5. Yhat a 6-foot masonry wail shall be const~ucted along the east and
south properEy lines.

6. That drainage of subJect property shall be disposcd of in a msnner
satisfactory to the City EngTncer,
7, Thai appropriate water assessment fees as determined by the Director of
Pubifc Utilities shall be paid to the Ctty of Anaheim prior to the issua~ce of a
building permit.
8. Tha[ subJect propcrty shall be developed substanttally in accordance
wlth plans and specifications on file with th~ City of Anaheim marke~ Exhibit Nos, 1~
2 and 3.

Conditlon Nos. 1 and 2, abovc-mentloned, shai) be completcd. The provislons or

10. That Condition Nos. 3, 4, S and 5, above-mentioned. shail be complied
with p~ior to final butiding and zoning inspectlons.
BE IT FURTHER RESOLVED that the Anaheim City Planning Cortmisslon does hereby
find and determine that adoption of this Resotution is expressly predicated upon
applicant's compliance with each and all of thc conditlons htrelnabove set forth.
Should any such condition, or any part ihereof, be declared invalid or unenforceable
by the final judgment of any court of competent JurisdTction, then this Resotution.
