A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
THAT REQUEST FOR MODIFICATION OF CONDITIONAL USE PERNIT N0. 1755.
BE GRANTED
WHEREAS, the petitioner submftted a request for modlfication to approval
contained in Planning Commisslon Resolution No. PC77-229 (to permit massage in an
existing figure salon for women only) on property consisting of approximately 0.9
acre located at the southeast corner of Lincoln Avenue a~d Empire Street; and
WHEREAS, the petitioner requasts modiftcation of the use :.s allowed in the
above-referred to resolution as follows:
"that the conditlonal use permit is gran[ed to permit massage in
an existing figure saton for women and for men."
WHEREAS, the Anaheim CiLy Planning Commission did hold a public hearing at
the City Hali in the City of Anaheim on May 22. 1978, at 1:30 p.m., notice of said
public hearing having been duly given as requlred by law and In accordance with the
provisions of the Anaheim Municipal Code, to hear and consider evidence for and
againsi said praposal to amend the condttlons of approval of Condi[tonal Use Permit
No, 1755, and io investigate and ma~e findings and recommendatTons in connection
therewith; and
WHEREAS,the Commission, after due inspection~ inves[igation and study made
by ttself and in fts behalf, and after due consideration of all evidence and reports
offered at said hearing, DOES NEREBY FIND:
1, That no one appeared at said public hearing in opposition to subJect
request; and that ~o correspondence was received in oppositton to
subjcct reGuest.
2. That the existing use for rromen has not had a detrimental effect on the
surrounding area and no compiaints from nearby residents or tenants
have been received regarding the use.
3. That the petttioner stipulated that the hours of operatlon will be from
8:00 a,m. to 10:00 p.m.
NCW, THEREFORE, BE IT RESOLVED~ tha[ the Anaheim City Planning Commtssion
does hereby grant the request for modiflcatlon to Conditional Use Permit No. 1755,
upon the fotlowing conditions which are hereby found to be a necessary prerequisite
to the proposed use of the subJect property in order to preserve the safety and
general welfare of the Citlzens of the City of Anahelm:
1, That this conditiona) use is hereby granted for a one-year period,
subJect to review and consideratlon for an extensTon of time, upon
written request by the petttloner~ to determine whether the use has
been detrimental to the nearby residentlal and commercial uses.

2, That the petitionc~ stipulated that the hours of operation shall be
from 3:00 a.m, to 10:00 p.m.
BE IT FURTHER RESOLVED that the Anaheim City Planning Commlssion does hereby
find and determine that adoption of this Resolution ls expressly predicated upon
applicant's compliance a~ith each and all of the condittons hereinabove set forth.
Shouid any such condition, or any part thereof, be declared lnvalid or unenforceabte
by the final Judgment of any court of competen[ jurisdiction, then this Resotution.
and any approvals hereln contained, shall be deemed null and void.
