by icself and in its behslf, and after due cons(deration af all evtdence and reports
offered at said heartng. does find and de[erninc the foltowing facts:
1. Thae the proposed use ls properly one for rrhlch a conditional use
permit is au[horized by Anaheim Munlcipal Code Section 18.21.050.110 to wit: to
permit expansion of church offices wlih waivers of:

2. That the proposed use is hcreby granted subJect to the petTtioner

church or the church assocTation vacate their portlon of subJect property. said
portion shall revert co the other user.
3. That the proposed waiver (a) is hereby granted on the basis that nearby
p~cpertles to the eas[ and west are developed Ntth t++o-story apartment bulldings and

a miniature golf course, none of which will be detrimentally impacicd by the proposed
18-foot hioh bullding.
4, That the proposed waiver (b) is hereby granted on the basis that there
will be a 50-foot wide landscaped setback between the proposed building expansion and
a s~cond buiiding on subject property, and said setback between buildings exceeds th~
reGuirement of 25 feet [o a rear property line but scrves the same purpose.
5. Tha[ the proposed use will not adversely affect the adJotning lartd uses
and the grow[h and developmen[ of the area in which t[ Is proposed to be locaced.
6, That the stze and shape of the site proposed for the use is adequate to
allow the full development of the proposed use in a manner not de[rimental to the
particular area no~ to the peace, health, safety, and general welfare of the Citfzens
of the City of Anaheim.
7, That the granting of the Conditio~al Use Permit under the conditions
imposed= if any. will not be detrimental to the peace, health, safety and general
weifare of thc Citizens of the C(ty of Anaheim.
8, That no one indicated their presence at said public hearing in
oppositTon; and that no correspondence was received in opposition to [he subject
petition. '
ENVIRO~JHENTAL IMPACT FItIDiNG: 7hat thc Anaheim City Planning Commissfon has
revlewed the subject project consisting of an expansion of church offices with
waivers of maximum structurai height artd minimum rear-yard setback on a
rectangularly-shaped parcel of land consistTng of approximately 2.2 acres having a
fron[age of approximatcly 180 feet on the south side of La Palma Avertue, havTng a
maximum depth of approximately 533 f~et and being located approximately 660 feet east
of the centerline of Magnolia Avenue; and does hereby approve the Negative
Deciaration from the requirement to prepare an env(ronmental impact report on the
basis that there rrouid be no stgnificant individual or cumulative adverse
environmeniat impact due io Lhe sppraval of thfs tlegative Reclaration since the
Anaheim General Plan desi9nates the subject proper[y for medium density residentTal
land uses commensurate with the proposal; [hat no sensitive environme~tal impacts are
involved in the proposal; that the Ini[tal S[udy submi[ted by the peticioner
indicates no significant individual nr cumulative adverse envtronmental impacts; and
that the Negative Declaration substantiat(ng che foregoing findings is on flle in the
Clty of Anahcim Planning Department.
NOW, THEREFORE, BE IT P,ESQLVEJ that the Anaheim C(ty Planning Comntssion
does hereby grant subject Petition for Conditional Use PermTt, upon the foliowing
conditlons which are hereby fou~d to be a netessary prerequtsite to [he proposed use
of the subJect property in order to preserve the safe[y and general weifare of the
Citizens of the City of Anaheim:
1, That subjnc[ properCy shall be developed substantlally in accordance
with the plans and spectf,:atfons on ftle with the City of Anaheim marked ExhtbTt
Nos. 1 through 5.

BE IT FURTHER RESOLVEO that the Anaheim City Planning Commission dces hereby
flnd and determine that ~doptlon of this Resolutton Ts expressly predicated upon
applicant's compllance with each and all of the conditions hereinabove set forth.
Shouid any such condttion~ or any part thereof, be declared invaltd or unenforceable
by the final Judgment of any court of competent jurisdtction, then this Resolution,
and any approvals herein contatned, shali be deemed nuil and void.
