A RESOLUTION OF THE ANAHEIM CITY PLANNING COHMISSION

NNEREAS, thc Anahelm City Planning Commission did receive a verified
petition for Reclassification from PRUI R. AND FRANCES B. GARONER, 31~9 West Orange
Avenue, Anaheim, CalTfornia 92804, owners.of certai~ real property situated in the
City of An~hetm, County of Orange. State of California:
The South 1.00 acre of the East 2.00 acres of the 11est 5.50 acres
of the East 7.00 acres of the Sou[h 8,00 acres of the East half of
[he Sou[hwest quarter of the Northeast quarter of Section 14,
Township 4 South, Rangc 11 West, in thc Rancho Los Coyotes. City
of Anaheim, Lounty of Orange, State of California~ as per map
recorded in book 51, Page 11, Miscellaneous Maps in the office of
Lhe county recorder of said counCy. EXCEPT the East 9G.00 fee[
thercof, EXCEPT that portlon thereof lying northwesterly of the
Sautheasterly tine of the land described in the deed to the Orange

41HEREAS~ the Liey Plan~ing Commission did hold a public hearing at the City
Hall in the Ctty of Anaheim on June 5. 1973, ~t ~~3~ P.m „ notice of said oublic
hearing having been duly given as required by law and in accordance with the
provisions of the Anaheim Municipal Code, Chapter 18.03. to hear and consider
evidence for and against said proposed reclassificatlon and to investigate and make
findtngs and recommendations in connection chereNith; and
41HEREAS, said Comnisslon~ after due inspection, investigation and study made
by Itself and (n its behalf, and after due consideration of a)1 evidence and reports
offered at said hearing, does find and determine thc following facts:
1, That the petttioner proposes reclacsificatton of subJect proaerty f~om
tfie RS-A-43,000 (ResidenciailAgricultural) Zane to the CL (Cortmercial, Limited) Z~ne.
2. That the Anahctm General Plan designates subJect property for
commercial professional land uses. •
3. Thai the proposed ~eclassificatfon is hereby granted, subject to the
petitioner's stipulation to realign the proposed drTveway located at the westerly end
of the subJect property (west of the proposed racquetball facility) tn accordance
with the requtrements of thc City Traffic E~gineer.
4. Tha[ the proposed reclassificatio~ of subJect property is necessary
and/or destrable for [he orderly and proper development of the community.
5, That the proposed reclassification of subject property does properly
relate to the zones and thelr permitted uses locally established in ctose proximity
to subJect property and to the zones and their permi[ted uses generally established
throughout the community.
6. Tn~t the p~'oposed reclassiflcatinn of subJect property requires the
improverient of abucting streets 9n azcordance with ihe Circulation Element of the
PC78-115
General Plan, due to the a~ticipated increase in traffic which wil) be generated by
the intensiffcation of land use.
7, That one person indicated her presence at said public hearTng in
opposition; and that no correspondence was received in opposition to the subJect
petition. and chat trro petitions containing twenty-nine (29j signatures in opposition
werc received.
ENVIRONMEIITAL IMPACT FINDING: That the Anahcim Ci[y Planning Commisston has
reviewed the subJect proposal to reclassify the zoning from RS-A-43,000
(Residential/Agricultural) to CL (Cammerciai, Limited) to construct a racquetball
facility and permi[ the continued use of an exis[ing office buildinq with waivers of
maximum structural height and minTmum sideyard setback on an irregularly-shaped
parcel of land consisting of approximatety 1.3 acres having a frontage of
approximately 358 feet on the north side of Orangc Avenuc and being located
approximatety 730 feet east of the centerline of Western Avenue; and does hereby
approve the Nega[ive Declaration from thc requirement to prepare a~ environmenta)
impact report on the basis ihat chere would be no significant individual or
cumulative adverse environmen:al impact due to thM approval of this Negative
Declaration since the Anaheim General Plan designates the subject property for
carimercial-professional land uses commensurate with the proposal; that no sensitive
environmental impacts are involved in the proposal; ttat the Initial Study submitted
by the ~etitioner indicates no significant individual or cu~+ulative adverse
environmental impacts; and that the Negative Declaration substantiating the foregoing
findings is on file in che City of Anaheim Planning Dcpartment.
NON~ THEREFORE. BE IT RESOLVED that [hc Anahcim City Planning tommission
does hereby grant subJect Petition for Reclassificacion and, by so doing, that 7itle
18-Zonl~g of the A~aheim Municipal Codc be amended to exclude the above-described
proper¢y fran the RS-A-4~~000 (RESIOENTIAL/AGRICULTURAL) ZONE and [o incorporate said
described property into the CL (COMMERGIAL, LINITED) ZQIIE upon the folloNing
conditions Nhich are hereby found to be a necessary prerequistte to the proposed use
of subJect property in order to preserve [he safety and general -+elfare of the
Citlzens of thc City of Anaheim:
1. 7hat the ormer(s) of subJcct propcrty shall pay to the Ctty of Anahetm
the sum of 95 ~ents pe~ front fooi along Orange Avenue for [ree pfanting purposes.
2, That street light(ng facilittes atong Orange Avenue shail be tnstalled
prlor to the final building and zoning inspectlons unlcss oth~rwise approved by Che
Direc[or of Public Utitities, and in accordance with standard specificatlons on file
tn tfie Office of the Director of Publlc Ucitities; and/or thai a bond. certificaie of
deposit, letter of credit. or cash~ in an amount and form satisfactory to ihe City of
Anaheim shall be posted with the City to guarantee the installation of the above-
mentioned requirements.
3. That trash storage areas shall be provided in accordance wlth approved
plans an file with the Offlce of the Dtrzctor of Public Norks.
4. That fire hydra~ts shatl be installed and cherged as required and
determined to be necessary by ehe Chief of the Fire Department prtor to commencemen[
of structural framing.
5. That subject property shall be served by underground utilities.

6. That dratnage of subJect property shall be disposed of in a manner
satisf~ctory to the Clty Enginecr.
7, That [he existing structure shall be brought up to thP~umbingm
standards of the City of Anaheim, Including the Uniform Building,
Electrical~ Mechanicat a~d Fire Codes as adopted by the City of Anaheim.
8. Thai the proposed driveway located a[ the westerly end of the subject
property (west of the proposed recquetball facility) shall be realigned~ subJect to
the review and approval of the City Trafflc Engineer.
9, Prior to the introduction of an ordlnance rezoning subJect property,
Conditlon I~os. 1 and 2, above-mentioned, shall be completed. The provisions or
rights granted by this resolution shall become null and void by action of the
Planning Commissio~ unless said conditions are complted wlth wlthin one year from [he
date hereof, or such further [ime as the Planning Commission may grant.
10. That Condition Nos. 3. 5. 6. 7 and 8~ above-mentioned, shall be
complied with prior [o final building and zoning inspections.
BE tT FURTfiER RESOLVED that the Anaheim City Planning Commission does hereby
find and determine that adoption of this Resolution is expressly predicated upon
applicant's compliance with each and ail of the conditions hereinabove set forth.
Should any such condition. or any part thereof~ be declared invalid or unenforceable
by the final Judgnent of any court of competent Jurisdiction, then thts Resolution~
and arty approvals heretn contai~ed~ shall bc deemed null and void.
