A RESOLUTION OF THE ANAHEIM CITY PLANNING CO}1HISSION
AHENDING A COtiDITION FERTAINING TO PARTICIPATION IN THE COST
OF TP.AFFIC SIGNAL INSTALLATION ADOPTED IN CONNECTION WITH
CONDITIONAL USE PEP.MIT N0. 1632.
WHEREAS~ the petitioner submitted a request for dcletfon of a conditlon of
approval contained in Planning Cortmission Resolution No. PC76-183 on property
consisting of epproximately 32 acres located northeasterly of the intersectTon of
Cerritos Avenue and Sunkist SLreet; and
WHEREAS~ the petitioner requcsts deletion of the following condition
co~tained in the above-referred-to resolutiort: .
"13. That the owner(s) of the subject property shall participate
in the costs of installing traffic signalization at the
intersectlon of Sunkist Strcet and Cerritos Avenuc, said
participation to be one-fourth of the to~al cost, as
recorynended by the City Traffic Engineer."
WHEREAS, the Anaheim Ctty Planning Lommission did hold a public hearTng at
the City Hall in the City of Anaheim on June 5, 1978. at 1:30 p.m.~ notice of said
public hearing having been duty aiven as required by law and In accord.~nce with the
provisions of the Anaheim Municipal Code, to hear and consider ~+Idence for and
against said proposal to amend the conditions of approval of Condltional Use Permit
No, 1632. and to investlgate and r.iake findings and recommendaiions in connection
thcrcwtth; and
NHEREAS~ said Commtssion, after due inspection, investlgation and stud; made
by itself and in i[s behalf, and after due consideration of all evidence and reports
ofFered at said hearing. DOES HEREBY FIND:
1, Tha[ no one appeared at said pub~lt hearina in opposition to
subJect request; and that no correspondence was received in
opposition to subJect request.
2, That the petitto~er posted a bond for the participation In
the cost of the instatling the traffic stgnal; subsequentiy,
however~ Ctty Council adopted Policy No. 214 pertaintng to
Traffic Signal Assessment in cannectlon with ~ew
constructlon.
3. That it would be more appropriate for the petittoner to pay
the TraffTc Slgnal Assessment rather than to participate in
[he cost of installing a specific traffic signai.
NOW~ THEREFORE, BE IT RESOLVED. that the Anahetm City Planning Lcrmiission
does hereby grant the request for amendment to Condltion No. 13 of Condttional Use
Permit No. 1632 to rcad as Follows:

BE 17 FURTHER RESO!VED that the Anaheim City Planning Lormn(ssion dces hereby
find and determine that adoption of this Resolutton Is expressiy predlcated upon
applicant's compliance with each and all of the conditions hereinabove set forth.
Should any such conditlon~ or any par[ Chereof, be declared Tnvalld or unenforceable
by the final Judgmant of any court of competent jurisdlction, then thls Resolution,
and any approvals hereln contained, shall be deemed nutl and void.
