A RESOLUTION OP THE ANAHEIM CITY PLANNING COMMISSION
REGOMMENDING TO THE C~TY COUNCIL OF THE CITY OF ANAHEIM
THAT TtfE REQUEST FOR AN ALTERNATE COHIIEP,CIAL USE I!! CON~lECTION

uHEREAS, the petitioner suhmttted a request for approval of an aiternate
commercial use contained in City Council Resolution No. 75R-134 and Ordinance No.
3435 adopted in connection with Reclassification No. 74-75-26 on property conststing
of approximately 4.C acres located at the southwest corner of Lincoln Avenue and
Su~ktst Street, havfng approx(mate frontages of 630 feet on the south sidn of Lincoln
Avenue and 220 fcet on the west side of Sunkist Street; and
WHEREAS, the petitioner requests approval of an alternate c«ronercial use of
the northeas[erly corner of subJect property which was reserved for use as a 4000
square foot flnancial butiding wich parking spaces for 203 vehicles tn the above-
referred-to resolution and ordinance of the City Council, to allow a?200 square foot
drug store; and
WFIEREAS, the Anaheim City Planning Commission did hold a public hearing at
[he City Hall in the City of Anahetm on June 19, 1~78, at 7:30 p.m,, notice of said
~ublic hearing having been duly glven as required by law and in accordance with [he
provisions of the Anaheim Municipal Code, to hear and consider evidence for and
aqatnsL said proposal to amend the conditions of approval of Reclassif)ca[ton No. 74-
75-2b~ and to investioate and make findfngs and recommendations in connection
therewi[h; and
WHEfiEAS, said Cortrnission, after due inspection, Inves[igation and study made
by itself and in its behalf, and after due considera[ion of all evidence and reports
offered at said heari~g, DOES kEREEY FIND:
1. That two (2} persons appeared at satd public hearing In oppositton; and
that no correspondence r~as received in opposition to the su6ject
requcst.
2. Tha[ the success of the recentiy developed supermari:et on subject
property has heavily impacted the vehicular traffic at the intersectton
of Sunkis[ Street and Lincoln Avenue, and has created parktng and noise
probiems; that deltvery trucks en[ering the site on Sunkist Street
which serves a residential area, are apparently not complylna wich the
stipulated delivery hours and have created noise. lighting, parking and
traffic problems for the residents in the arca; that the development
of a retail drug sCore (or discount center) instead of a financtal
building would add to these pro6lems, and that the proposed retail
store has a floor area more than two tfines larger than the originally
approved financial butiding and would aenPrat• ~i~niflcantly more
trafftc and would have an adverse impect on the nearby resldentlal
areas.
3. That the Planntng Canmission recortanends that the petitloner be
instructed to comply wi[h [he intent of the ortginal approval of the
reclassiftcation on the property. including development of a 4000
square foot building on the northeasterly corner of the proper[y~ and

that no increase of that square footage be considered due to the
existing trafflc, parking~ lighting and notse problems.
4. That the proposal is not necessary and/or desirable for the orderly and
proper development of the community.
5. That the proposal does no[ properly relate to the zones and theTr
permttted uses locally establlshed tn close proximTty to subject and to
the zones and their permitted uses generally established throughout [he
cortunun i ty.
ENVIRONMENTAL IMPACT FINDING: Thc Planning Director or his authorized
representa[ ve has determ ned that the proposed project falls within the definttion
of Categorlcal Exemp[tons. Class 5. as deflned in Paragraph 2 of [he Ctty of Anaheim
Enviornmental Impact Report Guidelines and is, therefore, ca[egoritally exempt from
the requirement to prepare an E~R.
NON~ THEREFORE. BE IT RESOLVED [hat the Anaheim Clty Plann(ng Canmisslon
does hereby recommend to [he City Councii of the City of Anaheim that the request for
approval of an alternate comnercia! use In connectton wlth Reclassiftcatlon tio. 74-
75-26 be denied on the basis of and subject co the forcgoing ftndings and
recommendatio~s.
