WHEREAS, the Anaheim City Planning Canmisslon did receive a verified
Petition for Conditional Use Permit from VIt~CENT D, JOYCE A~7D CHARLES LARRY CULWELL,
P. 0. Box 246, Donsail, California 92003, owner, and KARL P. Y.OCEK, 1309 Sou[h
Brookhurst Street, Anaheim, Lalifornia 92201~, agent, of certain real property
situated in the Ci[y of Anaheim, County of Orange, State of California, described as:
That portion of the Northeasc quarter of Section 1Q, Township 4
South, Ranae 10 1Jest, Rancho Los Coyo[es, shown on a Map recorded
in book 51, page 10 of Miscellaneous Maps, records of Orange
County, California, described as follows: Parcel 1 on a Map
recorded in bo~k 57, page 13 of Parcel Maos, records of Orange

WF(EREAS, the City Planning Crxnmission did hold a public hearing at [he Lity
Hall in the Lity of Anaheim on January lE, 1q78, at 1:30 p,m., notice of said public
hearing having been duly glven as required 6y lao-~ and in accordance with [he
provisions of the Anaheim Municipal Code, Chapter 13.03, to hear and consider
evidence for and aqainst said pronosed conditional use and to investi9ate and make
findings and recommendations in connect(on iherewi[h; and
WfiEREAS, said Commission, after due inspection, investiaa[1on and study made
by itself and in iCS behalf, and after due consideration of ali evidence and reports
offered at said hearing, does find and determinc the folloa~ing fac[s:
1, That [he proposed use is properly one for which a conditional use
permit is authorized by Anahe(m Municpal Lode Section 18,44.050.120 to wit: to
permit expansion of a presctiool, r~i[h waiver of;

2. That the proposal is approved for a maximun capacity of 120 children in
the entire preschool, as will be er.panded onto the subJect property in addition to
the existing facility on the adJacen[ parcel to the north (Conditional Use Permit No.
163?)•
3. That the aforementioned H~aiver is hereby granted on the basis that the
proposed 52-inch high fence within the reeuired setbac~ will be a continuatton of an
exlsting fence to the north and will not block the visibility of entering and exitiny
vehicles or passing pedestrians.
4. That the proposed use will no[ adversely affect the adJoining land uses
and the growth and development of the area in which it is oroposed to be located,
5. That the size and shape of the si[e proposed for the use is adequate to
allow the full development of thc proposed use in a man~er no[ de[rimental [o the
partlcular area nor to the peace. health, safety and general welfare of the Citizens
of the Cfty of Anaheim.

6. That the granting of the Conditional Use Permit uncier the conditions
imposed, if any, will not be detrimental to the peace, health, safety and general
welfare of the Citizens of the City of Anaheim.
7, That no one indicated their presence at said public hearing in
opposition and that no correspondence was received in opposition to the subJect
petition.
EtlVIRONMENTAL IMPACT fINDING: The Director of [he Planning Department has
determined that the proposed activity alls within the definition of Section 3.01,
Class 3, of the City of Anaheim Guidelines to the Requirements for an Environmental
Impact P.eport and is, therefore, categorically exempt frorn the requirement to file an
EIR.
N061, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby 9rant subject Petition for Conditional Use Permit, upon the following
conditions which are hereby found to be a necessary prerequisite to the proposed use
of the subject property in order to preserve the safety and gencral welfare of the
Citizens of the City of Anaheim:
1. That appropriate o~ater assessment fees as determined by the Director of
Public Utilities shall be paid to the City of ~naheim prior to the issuance of a
building permit.
2. That subject property shall be developed subs[antially in accordance
with plans and specifications on file o-~ith the Lity of Anahetm marked Exhibit yos. i
and 2.
